AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, SETTING THE MAXIMUM ANNUAL SALARY FOR THE CITY CLERK FOR
CALENDAR YEAR 2009
Statement of Purpose and Intent
The City Clerk serves as Clerk of the Common Council under Indiana Code § 36-4-6-9
and maintains custody of its records. The City Clerk is also charged with maintaining all records
as required by law; keeping the city seal; administering oaths; taking depositions; attending all
regular and special meetings of the Council; and performing other duties as required by the
Common Council.
The Common Council is required by under Indiana Code § 36-4-7-2 to fix the annual
compensation of all elected city officers, with such an ordinance being published at least thirty
(30) days before final action by the Council.
Indiana Code § 36-4-11-4 authorizes the City Clerk to appoint "the number of deputies
and employees authorized by the city legislative body". In the interest of fairness, the following
ordinance sets forth the same percentage increase for the City Clerk as requested for the deputies
and employees in the City Clerk's Office.

Section I. The annual compensation for the City Clerk of the City of South Bend,
Indiana, shall be established at a maximum amount of $52,800.00 for the 2009 calendar year.
Section II. This ordinance shall be in full force and effect from and after its passage by
the Common Council, approval by the Mayor and legal publication.

Re: Proposed 2009 City Clerk Salary Ordinance
Dear Honorable Members of the South Bend Common Council:
The attached ordinance would establish the maximum amount for the salary of the City Clerk for
the 2009 calendar year. It proposes the same percentage increase which I have proposed for my
hard-working City Clerk's staff, namely 2%, which would be the maximum permitted if passed.
As you are well aware, the Office of the City Clerk, continues to take on more responsibility to
assure that the multi-faceted services which are provided by this office are provided in a prompt,
efficient and timely manner.
Your favorably action on this proposed ordinance is respectfully requested. Thank you.
