AN ORDINANCE TO REGULATE AND CONTROL THE SALE AND USE OF PLASTIC COVERINGS OR BAGS. BE IT ORDAINED by the Common Council of the City of South Bend that: SECTION I. No person shall use, deliver, or possess for use for delivery, any plastic bag the length and width of which, when added together, totals twenty -five (25 ") inches or more and which is less than one mil in thickness as a cover or container for any product or substance, unless such bag bears the following warning statement, or such warning statement which the Board of Health has approved as the equivalent thereof: "WARNING - TO AVOID DANGER OF SUFFOCATION KEEP AWAY FROM BABIES AND CHILDREN. DO NOT USE IN CRIBS, BEDS, CARRIAGES OR PLAYPEN. THIS BAG IS NOT A TOY. " Such warning statement shall be imprinted in a prominent place on the plastic bag or shall appear on a label securely attached to the bag in a prominent place, and shall be printed in English in legible type which should be constrasted by typography, layout or colors from the contents of the bag and from other printed matter on the bag, if any. The size of the print of such statement shall be as follows: Total length and width of ba 60" 40 -59" 30 -39" 25 -30" Size of print At least 24 point At least 18 point At least 14 point At least 10 point SECTION II. Any and all persons, firms, corporations who shall violate any of the provisions of this ordinance or fail to comply therewith or who shall violate or fail to comply with any order or regulation made thereunder shall severally and for each and every violation and non - compliance respectfully be penalized in a sum not to exceed Fifty ($50. 00) Dollars. The imposing of one penalty for any violation of this ordinance shall not excuse the violation or permit it to continue; and all such persons, firms or corporations shall be required to correct or remedy such violation or defect within a reasonable time. SECTION III. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor of the City of South Bend, and legal publication.
