AN ORDINANCE ORDERING AND PROVIDING FOR THE SAIE OF CERTAIN REAL ESTATE IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, WHICH SAID REAL ESTATE IS OWNED BY SAID CITY FOR USE OF ITS PARK DEPARTMENT. WHEREAS, after due consideration and deliberation, the Board of Park Commissioners of the City of South Bend, Indiana, does determine that the real estate hereinafter described is no longer suitable or required for park purposes because of its restricted area and is not now susceptible for development for park purposes, and, WHEREAS, The Housing Authority of the City of South Bend, Indiana is desirous of acquiring said real estate for building dwelling units, and, WHEREAS, it has been found by said Board of Park Commissioners that said real estate can be sold and disposed of to the advantage and best interests of the City of South Bend, Indiana, and, WHEREAS, said Board of Park Commissioners has prepared, delivered and submitted this ordinance to the Common Council of the City of South Bend, ordering and authorizing the sale of said real estate as by law provided, and, NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, Indiana: Section 1. That the City of South Bend, Indiana, sell and convey the following described real estate in South Bend, St. Joseph County, Indiana, to -wit: All that part of Bank Out Lot Numbered 92 of the Second Plat of Out Lots of the Town, now City of South Bend, that lies North of the present right of way of the New York Central Railroad Company and North of the right of way of the Grand Trunk Western Railroad Company, that is all of said Lot Numbered 92 that lies between said Railroad Companies right of ways. Also Lots Numbered 1 to 22 inclusive in James Reynolds Subdivision (now vacated) of a part of Bank Out Lot No. 91 of the Second Plat of Out Lots of the Town, now the City of South Bend, together with the vacated alleys in said Sub - division and vacated Reynolds and Perkins Street, excepting therefrom a strip of land off of the South side thereof hereto- fore conveyed to the New York Central Railroad Company by a Deed dated March 28, 1928 and recorded March 29, 1928 in Deed Record 216, pages 608-9, said tract being more fully described as follows: Beginning on the West line of Laurel Street in the City of South Bend, at a point 254 feet South and 20 feet West of the intersection of the East line of Bank Out Lot Numbered 91 with the Southerly right of way line of the Grand Trunk Western Rail- road Company; thence West along the North line of said Reynolds Sub- division (now vacated), a distance of 326.5 feet to the West line of said Bank Out Lot Numbered 91; thence South along said line to the Northerly line of the right of way of the New York Central Railroad as established by a Deed to said Railroad in Deed Record 216, pages 608 -9, thence Southeasterly along the North line of said right of way to a point on the West line of Laurel Street 637.7 feet South of the South line of Western Avenue; thence North along the West line of Laurel Street, 357.3 feet, more or less, to the place of beginning. Section 2. That the Judge of the Circuit Court of St. Joseph County, Indiana be requested to appoint three (3) disinterested freeholders of the City of South Bend, Indiana to appraise the above described real estate. Section 3. That the Mayor of the City of South Bend be and he is hereby authorized, empowered and directed to sell and convey on behalf of the City of South Bend, the above described real estate free and clear of ali liens and encumbrances for an amount not less than the appraised value of said real estate as determined by the appraisers appointed by the Judge of said Court. Section 4. That, upon receipt of the purchase price, said real estate shall be conveyed to the purchaser by a deed executed by the Mayor, in the name of the City, attested by the City Clerk and with the seal of the City affixed thereto; that said deed shall be in form sufficient to convey the fee simple title of said real estate of the purchaser and shall contain covenants of the City that it has not made, done, committed or suffered any act or acts whereby said real estate or any part thereof may be impeached, charged, or encumbered. Section 5.
