AN ORDINANCE. TO AMEND CHAPTER 12, ARTICLE II,
SECTIONS 2 to 13 INCLUSIVE, OF THE MUNICIPAL CODE
OF THE CITY OF SOUTH BEND, APPROVED AND SIGNED
BY THE MAYOR OF THE CITY OF SOUTH BEND, JULY
12, 1949, AND ALSO KNOWN AS ORDINANCE NO. 2948.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
SECTION I. That Chapter 12, Article 2, Section 2 be amended to read
as follows:
SECTION 2. Peddler defined; license required.
Every person who shall sell, or offer for sale, goods, wares,
or merchandise, directly to a consumer, by going from house
to house for the purpose of selling such goods, or by selling
such goods from a pack or vehicle, directly to a consumer,
going from house to house, and every person who shall offer
any goods, wares, meats, milk, fish, foodstuff, bread, vege-
tables, fruits, garden truck, farm products or provisions,
ice - cream, candy and sundries, on any public road, street,
square or other place, shall be determined a peddler, and
shall, before engaging in such business obtain a peddler's
license as herein provided.
SECTION II. That Chapter 12, Article 2, Sections 3 and 4 be amended to
read as follows:
SECTION 3. License Fees.
The application for license shall be made to the office of the
Controller. All licenses shall be issued for the calendar
year, or, for the balance of the calendar year, if such appli-
cation for license is made after the first of January. All
licenses shall continue until the 31st of December and all
licenses shall expire at said date.
The fees for licenses for a peddler using a pushcart, wagon,
motor vehicle, or any type vehicle, shall be as follows:
(1) Twenty -five ($25.00) Dollars for the calendar year
(2) The fee for application of license made between the
1st of April to and including the 30th of June, shall be
$18. 75 for the balance of the calendar year.
(3) The fee for application of license made between the
1st of July to and including the 30th of September, shall
be $12. 50 for the balance of the calendar year.
(4) The fee for application of license made between the
1st of October and the 31st of December, shall be
$6. 25 for the balance of the calendar year.
The license fees for pack peddlers or for any other type of
peddler who shows his wares, shall be as follows:
(1) Twelve ($12. 00) Dollars for the calendar year.
(2) The fee for application of license made between the
1st of April to and including the 30th of June, shall be
$9. 00 for the balance of the calendar year.
(3) The fee for application of license made between the
1st of July to and including the 30th of September, shall
be $6. 00 for the balance of the calendar year.
(4) The fee for application of license made between the
1st of October and the 31st of December, shall be $3. 00
for the balance of the calendar year.
The owner and operator of a pushcart, wagon, motor vehicle,
or any other vehicle, who operates on a public road, street,
square or other place, and sells his merchandise from said
vehicle, and in addition thereto, sells his merchandise on a
stand or stands, outside of his vehicle, shall also pay the
following license fees:
(1) Ten (10.00) Dollars for the calendar year.
(2) The fee for application of license made between the
1st of April to and including the 30th of June, shall be
$7. 50 for the balance of the calendar year.
(3) The fee for application of license made between the
1st of July to and including the 30th of September, shall
be $5. 00 for the balance of the calendar year.
(4) The fee for application of license made between the
1st of October to and including the 31st of December,
shall be $2. 50 for the balance of the calendar year.
SECTION III. That Chapter 12, Article .2, Sections 5 to 13 inclusive, shall
be amended to read as follows:
Section 5. Badge or Tag., shall become Section 4. Badge or
Tag.

Section 6. Metal Number Plates., shall become Section 5;
Section 7. Issuance of License., shall become Section 6;
Section 8. License Not Transferable, shall become Section 7;
Section 9. Exemption as to sale of newspapers and sales by
producers of farm products; affidavit required, shall become
Section 8;
Section 10. Exemption of War Veterans., shall become
Section 9;
Section 11. Peddlers to keep moving except when negotiating
sales., shall become Section 10;
Section 12. Open Air Stands., shall become Section 11; and
Section 13. Certificate required as to weights and measures,
shall become Section 12.
SECTION IV. This Ordinance shall be in full force and effect from and after
its passage by the Common Council, its approval by the Mayor
and the fulfillment of all statutory requirements relating thereto.
