AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE
CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
Section 1:
That the following described property in St. Joseph County
State of Indiana, is hereby annexed to and brought within the
City of South Bend, Indiana:
A tract of land situated in the North Half of the
Northwest Quarter of Section 31, Township 37 North, Range
3 East, described as beginning at the Northeast corner of
the Northwest Quarter of Section 311 Township 37 North,
Range 3 East, running thence West along the North line of
said Quarter Section, 826 feet, thence South 866.5 feet,
thence East 226.19 feet to the center line of the formerly
proposed Overlook Road, thence South along the center line
of the formerly proposed Overlook Road 371 feet, thence
East 602 feet to the East line of said Quarter Section,
thence North along the East line of said Quarter Section
1237.5 feet to the place of beginning.
Section 2-
No building permit shall be issued with respect to the
foregoing property, and no change in use thereof, or change in
structures that now exist thereon, shall be permitted for a per
of 180 days from the date of the adoption of this Ordinance, or
until the Council shall zone the foregoing property, whichever
date is the earlier.
Section 3•
This ordinance shall be in full force and effect from and
after its enactment, approval by the Mayor

The attached petition of Andrew S. Place to annex to
the City of South Bend, Indiana 21.5 acres in Section
311 T37N, R3E, being generally described as having 826
feet frontage on the south side of Jackson Road, and
lying midway between Ironwood and Miami Roads was
legally advertised under date of August 27, 1962 and
given public hearing on September 6, 1962. The following
was taken:
After due consideration the Commission found
that in their opinion the six determinants of
the annexation apply to the area in issue. It
was therefore duly moved, seconded, and unanimously
carried that the petition be recommended favorably
to the Council on the condition that no Building
Permit shall be issued by the Building Commissioner
and no change in use or bulk of structures existing
shall occur until the area has been properly
zoned by the City Council or a period of 180 days
from the effective date of the ordinance has
lapsed.
