HomeMy WebLinkAboutAnnexing to and Bringing within the City, Ironwood Drive, Roosevelt StreetORDINANCE No. 4417 - - -61 Passed by the Common Council of the City of South Bend, NOVEMBER 27, __ 61 Clerk r of Common Council Presented by me to the Mayor of the City of South Bend, NOVEMBER 28, 19-6i Clerk Approved and signed by me NOVEMBER 28. 19 61 IDEAL G4jjFA0D PRESS ORDINANCE NO. 4417 - - -61 AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS, AS AMENDED BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I: That the following described property in St. Joseph County, State of Indiana, is hereby annexed to and brought within the City of South Bend, Indiana: Beginning at a point in the SW'k, Sec. 32, T38N, R3E, at the intersection of the centerline of Edison Road (the present City limits) and the centerline of Ironwood Drive, thence north along the centerline of Ironwood Drive,(which is also the west line of the SW'k, Sec. 32, T38N, R3E,) a distance of 660 feet, more or less, thence east a distance of 396 feet, more or less, thence north parallel with the west lice of said Quarter Section a distance of 660 feet, more or less, thence west a dis- tance of 202 feet, more or less, thence north parallel with the west line of said Quarter Section a distance of 305 feet, more or less, to the south right -of -way line of Roosevelt Street, thence west a distance of 234 feet, more or less, to the west right -of -way line of Ironwood Drive, thence north along the west right -of -way line of Ironwood Drive to the southerly right - of -way line of South Bend Avenue (Indiana 23), thence southwesterly along the southerly right -of -way line of South Bend Avenue (Indiana 23) to a point in the SE'k, Sec.31, T38N, R3E, at the intersection of the southerly right -of -way line of South Bend Avenue (Indiana 23) and the south lot line of Lot Number 8, Wolfe's South Bend Avenue Addition, (Proposed), thence east a distance of 279 feet, more or less, to the northeast corner of Lot Number 19, Pensinger's Sub., thence south a distance of 662 feet, more or less, to the southeast corner of Lot Number 1, in said Pensinger's Sub., thence east a distance of 400 feet, more or less, thence south parallel with the east section line of the SE'k of Section 31 a distance of 660 feet, more or less, to the centerline of Edison Road (the present city limits), thence east a distance of 330 feet, more or less, to the point of beginning contain- ing 51 acres, more or less. SECTION II: This Ordinance shall be in full force and effect from and after its enactment, approval by the Mayor and Legal publication. Passed by the Common Couceil, November 27, 1961. The attached petition of the Common Council to annex to the City of South Bend, Indiana, a parcel of land being generally described as the frontage on Ironwood Road between Edison Road and South Bend Avenue, said parcel containing approximately 57 acres, was legally advertised under date of October 23, 1961 and given public hearing on November 2, 1961. The following action was taken: After due consideration the Commission found . that in their opinion: 1. The annexation is in the best interests of the city and of the territory sought to be annexed. 2. The area is urban in character, being an economic and social part of the annexing city, 3. The city is financially able to provide municipal services to the annexed area within the reasonably near future. 4. The area sought to be annexed is needed for development of the city in the reasonably near future. 5. The lines of the annexation are so drawn as to form a compact area abutting the municipality, -2- The Honorable Common Council of the City of South Bend It was therefore duly moved, seconded, and unanimously carried that the petition be recom- mended favorably to the Common Council.
