BE IT ORDAINED by the Common Council of the civil City of South Bend, Indiana: Section 1. That Ordinance No. 3702 adopted by this Common Council on the 14th day of June, 1949, more commonly known as the Zoning Ordinance, be amended by rezoning of a certain parcel of land located in the City of South Bend, County of St. Joseph, State of Indiana, known and described as follows, towit: "Lots No. 5 and 6 in A. H. Haberle and Blanche Turner to rezone from "B" Residential Use and "B" Height and Area District to "C" Commercial Use and "B" Height and Area District Lots Numbered 5 and 6 in A. H. Cushing's Addition, more generally described as the half block bounded on the south by Lincoln Way West on the east by T Allen Street, on the north by Lindsay Street, and on the west by a public alley was legally advertised under date of June 25, 1962 and given public hearing on July 5, 1962. The following action was taken: After due consideration the Commission found that the proposed zoning would result in an unwarranted intrusion of commercial zoning into a predominantly residential area; that the granting of the petition would constitute spot zoning; and that ample commercial zoning not used for commercial purposes presently exists in the immediate vicinity.
