BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
Section 1:
That Zoning Ordinance No. 3702, as heretofore amended
and supplemented, be and the same is hereby amended and
supplemented by changing the zoning classification of the
following described property from "C" Commercial Use and "D"
Height and Area District to "B" Residential Use and "A"
Height and Area District:
Lots Numbered 5, 8; 9,'12,'13, 17,'209
21, 229 23, 24, 257 26, 27, and 28, Stovers
Sub. of B.O.L.81;and Lots Numbered 1, 2,
5t-67 71 15, 169 177 187 197 209 21, 22,
237 249 259 269 39, 38, 37, 407 41, 42,
659 64, 63, 66, 67, and 68, Arnold &
Pagin's Sub.
Section 2:
This Ordinance shall be in full force and effect from
and after its enactment, approval by the Mayor and legal
publication.

Gentlemen:
The attached proposed ordinance originated by the City
Planning Commission to rezone from "C" Commercial Use
and I'D" Height and Area District to "B" Residential Use
and "At' Height and Area District Lots Numbered 5, 8, 91
12, 13, 17, 20, 21, 22, 23, 24, 25, 26, 27, and 28,
Stovers Sub, of B.O.L. 81; and Lots Numbered 1, 21 57 69
7, 46, 15, 16, 17, 18, 19, 20, 21, 22, 231, 24, 25, 26,
39, 38, 37, 40, 41, 42, 65, 64, 63, 662 67, and 68,Arnold
& Pagints Sub.; more generally described as both sides of
Birdsell Street from the first east -west alley north of
Washington Street, north to Linden Street and the south
side of Linden Street from Birdsell Street east to Walnut
Street, was legally advertised under date of May 28, 1962
and given public hearing on June 14, 1962. The following
action was taken:
After due consideration the Commission found
that the best zoning for the area in question
would be residential. It was therefore duly
moved, seconded, and unanimously carried that
the petition be recommended favorably to the
Council. It was further a sense of the
meeting that as a reflection of the sentiments
expressed at the hearing the ordinance be
amended from the floor to read "A" Residential
Use and "A" Height and Area District, the Com-
mission being unable to amend from the adver-
tised ordinance, thus requiring additional ad-
vertising and another public hearing.
