BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1•

. That Zoning Ordinance No. 3702, as heretofore amended
and supplemented, be and the same is hereby amended and
supplemented by changing the zoning classification of the
following described property from "D" Light Industrial Use
and "E" Height and Area District to "B" Residential Use and
"A " Height and Area District:
Lots Numbered 7, 8; 13, 14, 15; 167 21,
22, 23, 24; 29, 30, 31, 329 37, 38, 399
40, and 42, John F. Kirby Sub. of Pt,
B.A.L. 83.
Section 2•
This Ordinance shall be in full force and effect from
and after its enactment, approval by the Mayor, and legal
publication.

AMENDED AND SUPPLEMENTED (Cherry Street South of Washington)
Respectfully report that they have examined the matter and that in their opinion

Gentlemen:
The attached proposed ordinance originated by the City
Planning Commission to rezone from "D" Light Industrial
Use and "E" Height and Area District to "B" Residential
Use and "A`, Height and Area District Lots Numbered 7, 8,
137 141 151 16, 21, 22, 23, 24, 29, 30, 31, 32, 37, 38,
39, 40, and 42, John F. Kirby Sub, of Pt. B.O.L. 83, more
generally described as the east side of Cherry Street
from the first lot south of Washington Street south to
the New York Central Railroad tracks plus one lot on the
west side of Chestnut Street, was legally advertised
under date of May 28, 1962 and given public hearing on
June 14, 1962. The following action was taken:
After due consideration the Commission found
that the best zoning for the area in question
would be residential. It was therefore duly
moved, seconded, and unanimously carried that
the petition be recommended favorably to the
Council, It was further a sense of the
meeting that as a reflection of the sentiments
expressed at the hearing the ordinance be
amended from the floor to read "A" Residential
Use and "A" Height and Area District, the Com-
mission being unable to amend. from the adver-
tised ordinance, thus requiring additional ad-
vertising and another public hearing.
