AN ORDINANCE APPROVING, RATIFYING AND CONFIRMING A
CERTAIN CONTRACT AND AGREEMENT MADE AND ENTERED
INTO BY AND BETWEEN THE CITY OF SOUTH BEND, INDIANA;
SAFETY. AND NORTHERN INDIANA TRANSIT, INC.. ITS SUC-
THE RATE
WHEREAS, heretofore, to wit: on the ,�13 day of February, 1962,
the City of South Bend, Indiana, acting by and through its Board of Public
Works and Safety, entered into the following contract with Northern Indiana
Transit, Inc.:
CONTRACT
THIS CONTRACT, made and entered into this
day of February, 1962, by and between the CITY OF SOUTH BEND,
INDIANA, acting by and through its Board of Public Works and
Safety, hereinafter called the First Party, and NORTHERN INDIANA
TRANSIT, INC. , a corporation organized under the laws of the
State of Indiana, its successors and assigns, hereinafter called
the Second Party,
WITNESSETH-
The parties hereto agree that the certain contract
made between the parties on or about May 13, 1940 and thereafter
confirmed by Ordinance of the Common Council of the City of
South Bend, and as subsequently further amended and confirmed
by Ordinances of the Common Council of the City of South Bend,
the last amendment by contract dated January 30, 1958, and con-
firmed by Ordinance of the said Council, shall be and is hereby
amended in each of the following respects:
All provisions in said Contract, as amended, regarding
token fares shall be eliminated, and said provisions relating to
cash fares shall remain as in said amended Contract provided, to wit:
1. Cash Fares . . . . . . . . . . . 25�
2. Special Children's Fares:
a. All children under five years of age,
accompanied by a fare paying passenger No Charge
b. All children age 5 years to 12 years,
both inclusive, at all times 10�
c. School fares for high school and grade school
students over 12 years, attending school be-
tween the hours of 6:30 A. M. and 4 :30 P. M. 15¢
All provisions in said contract, as amended, regarding
transfers, shall remain the same.
The Second Party shall furnish service to the public over
the routes now presently established.
Said contract made between the parties on the 13th day
of May, 1940, amended as hereinabove set forth, and as now
amended, shall be and is hereby continued in full force and effect.
Executed in triplicate by the parties on the day first
above mentioned.

AND WHEREAS, said contract has been submitted by said Board of Public
Works and Safety of the City of South Bend, Indiana, to the Common Council of
said City for its consideration and action thereon:
THEREFORE,
Section 1. BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana, that the foregoing contract and agreement, made and
entered into the day of February, 1962, by the City of South Bend,
Indiana, acting by and through its Board of Public Works and Safety, and.
Northern Indiana Transit, Inc., be and the same is hereby in all things ap-
proved, ratified and confirmed, and said Northern Indiana Transit, Inc., its
successors and assigns, is hereby granted the right, privilege and authority
as in said contract and agreement set forth, and in accordance with the terms,
provisions and contents thereof.
Section 2. This ordinance shall take effect and be in force from
and after its passage by the Common Council and approval by the Mayor of
the City of South Bend, Indiana.
