I ~ ' AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21, ARTICLE 6, DIVISION 2, EXCEPTIONS TO DISTRICT REGULATIONS, OF THE SOUTH BEND MUNICIPAL CODE TO ALLOW CERTAIN TYPES OF MANUFACTURING RETAILERS IN THE "A-3" MIXED USE MULTIFAMILY RESIDENTIAL AND COMMERCIAL DISTRICT STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to amend Chapter 21 of the South Bend Municipal Code to allow certain types of manufacturing retailers as Special Exceptions in the "A- 3" Mixed Use Multifamily Residential and Commercial District. The Common Council of the City of South Bend recognizes its duty to enact zoning ordinances to promote the general health, welfare and safety of residents of the City of South Bend. Now, Therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: follows: section: Section I. Chapter 21, Article 6, Section 21-117.01 - 22-117.04 Reserved be amended as Section 21-117.01 - 21-117:84 .03 Reserved Section II. Chapter 21, Article 6, Section 21-117 be amended by adding the following Sec. 21-117.04 Exception in the "A-3" Mixed Use Multifamily Residential and Commercial District. (al The following exception may be permitted in the "A-3" Mixed Use Multifamily Residential and Commercial District. 11 Manufacturing retailers such as confectioners,_bakeries, brewpubs where food or beverage products are sold_on the same_premises where they are produced, provided that the Zoning Board of Appeals and the Common Council determine that the use will further the Citv's goal of making the downtown and East Bank area a regional entertainment and tourist center. Section III. Jefferson Boulevazd South Bend, IN 46601 Fax 219 235-9813 RE: Area Plan Commission Initiated Petition to Amend the Zoning Ordinance to Allow Certain Types of Manufacturing/Retailers in the "A-3" Zoning Districts Dear Ms. Pfeifer: Attached is a proposed ordinance that was initiated by the Area Plan Commission. The purpose of this ordinance is to allow certain types of manufacturing/retailers, such as The South Bend Chocolate Factory, in the City's "A-3" Mixed Use Multifamily Residential and Commercial District. These uses will be allowed as Special Exceptions. Please place this proposed ordinance on the December 11, 2000, Common Council agenda for first reading. The Area Plan Commission at its public hearing on December 19, 2000, took the following action: Upon a motion by John McNamara, being seconded b~ Karl King and unanimously carried, the pproposed ordinance initiated by the Area Plan Comm>tss><on amending Chapter 21, Article 6, Division 2, Exceptions to District Regulations of the South Bend Municipal Code to allow certain tykes of manufacturing retailers in the "A-3" Mixed Use Multi-family Residential and Commercial DDistrict is sent to the Common Council with a favorable recommendation. The types of uses that would be allowed by this amendment would further the City's goal of making the downtown and East Bank area a regional entertainment and tourist center. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation. The types of uses that woul be allowed by this amendment would further the City's goal of making the downtown and East Bank area a regional entertainment and tourist center.
