BEING A PART OF SAID PECK'S 2~ SUBDIVISION TO
THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY,
INDIANA
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12, the Common Council
is charged with the authority to hear all petitions to vacate
public ways or public places within the City.
The following Ordinance vacates the above described public
property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend
having held a public hearing on the petition to vacate the
following property:
The alley to be vacated is the first east/west alley north of
Fisher Street from the west R/W line of Webster Street to the west
lot line of lot 18, Peck's 2nd subdivision of part bank outlots 10
and 02 for a distance of 210 feet. Being a part of said Peck's 2nd
subdivision to the city of South Bend, St. Joseph County, Indiana
Hereby determines that it is desirable to vacate said property.
SECTION II. The City of South Bend hereby reserves the rights
and easements of all utilities and the Municipal City of South
Bend, Indiana, to construct and maintain any facilities, including,
but not limited to, the following: electric, telephone, gas,
water, sewer, surface water control structures and ditches, within
the vacated right-of-way, unless such rights are released by the
individual utilities.
.SECTION III. The following property may be injuriously or
beneficially affected by such vacating:
LOT NUMBERS 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16,
17,18: SAINT CASIMIR'S CATHOLIC CHURCH
SECTION IV. The purpose of the vacation of the real property
is because the east end of this alley and its egress to Webster
Street was blacked in 1925 when the present St. Casimir Church was
built . The alley under the church was never vacated. Traffic from
the east end of the alley currently egresses through parish grounds
to the north of the alley. This traffic through parish property
creates hazards for people using parish facilities and liability
concerns for the parish. The parish wishes to stop public traffic
through the parish grounds without creating a dead end for the
alley in the middle of the parish grounds. This ordinance vacates
the length of the alley which parish property abuts on both sides.
This ordinance shall be subject to the petitioner providing an
ingress/egress easement to the City of South Bend to permit the
division of Solid Waste to have access for trash pick-up, access
through any gated areas installed by the petitioner shall be
permitted with such access for City utility purposes not being
unreasonably withheld by the petitioner. All such conditions shall
be completed within thirty (30)days from the date of passage with
copies of all agreements being filed with the Office of the City
Clerk.
SECTION VI. This ordinance shall be in full force and effect
from and after its passage by the Common Council, and approval by
the Mayor.

Respectfully report that they have examined the matter and that in their opinion, this bill is being
recommended to the full Council with a favorable recommendation as amended as follows: Add
to the end of Section IV: This ordinance shall be subject to the petitioner providing an
ingress/egress easement to the City of South Bend to permit the division of Solid Waste to have
access for trash pick-up, access through any gated areas installed by the petitioner shall be

Re: Vacation of alley
The east portion of the alley between the 1300 block of West Fisher and West
Dunham Streets is a problem for Saint Casimir Roman Catholic Church. The east
end of this alley and its egress to Webster Street was blocked in 1925 when the
present St. Casimir Roman Catholic Church was built. The alley under the
church was never vacated. Traffic from the east end of the alley currently
egresses through parish grounds to the north of the alley. This traffic through
parish property creates hazards for people using parish facilities and liability
concerns for the parish. The parish wishes to stop public traffic through the
parish grounds without creating a dead end for the alley in the middle of the
parish grounds. The proposed ordinance vacates the length of the alley which
parish property abuts on both sides.

In accordance with Municipal Code Section 18-53.8, an unfavorable recommendation is
being submitted to the Common Council concerning the following vacation:
The first east/west alley north of Fisher Street from the west IZ/W line of Webster Street to
the west lot line of Lot 18, Peck's 2°d Subdivision of Part Bank Outlots O1 and OZ for a
distance of 210 feet. Being a part of said Peck's 2°d Subdivision to the City of South Bend,
St. Joseph county, Indiana.
For your information, the Board received favorable recommendations concerning this
Vacation Petition from the Police Department, Fire Department, and the Department of Economic
Development, subject to any utility easements that maybe required. The Division of Engineering
has stated that this vacation would create a dead end alley. The relief to this situation is the
traffic outlet that the church desires to eliminate. Area Plan stated that St. Casimir Church
is built over an alley that was never vacated. The vacation would also need to be subject to a
turning radius easement at the eastern extent of the alley for alley traffic from the east. Solid
Waste did not give a recommendation, however, trash would need to be picked from the front
of the residences, rather than in this alley.
Therefore, the Board submits to you an unfavorable recommendation concerning this
vacation.

THIS GRANT OF EASEMENT made this /O~`~c~ay of FEE: 1,~6~
by the St. Casimir ~ Church, 1308 Dunham, South Bend, Indiana, (Grantor), in favor of the City of
South Bend, Indiana (Grantee).
WITNESSETH THAT:
WHEREAS, St. Casimir ~ Church owns certain real estate located at ADDRESS in the City
of South Bend, Indiana; and
WHEREAS, the City of South Bend, Indiana desires a right of ingress and egress upon St.
Casimir' :church property from a vacated alleyway off of Dunham; and
WHEREAS, St. Casimir ~~ Church desires to grant rights of easement for the purposes of
ingress and egress, inasmuch as it presently appears such grant of easement will assist the City in
maintenance, trash pick-up and other City functions.
NOW, THEREFORE, for and in consideration of the foregoing, of the agreements and
covenants herein contained and other good and valuable consideration given by each party hereto
unto the others, the receipt of sufficiency of which is hereby acknowledged, the parties agree as
follows:
1. Grant of Easement. St Casimir .Church of 1308 Dunham, South Bend, Indiana, does
hereby grant to the City of South Bend, an exclusive right, privilege and easement for ingress and
egress to the City of South Bend, Indiana, in the alleyway located at 1308 Dunham, South Bend,
Indiana, as designated on Exhibit "A" -Diagram of property of St. Casimir Church and legal
description.
2. Access. St. Casimir Church of 1308 Dunham, South Bend, Indiana, agrees to grant the
City of South Bend a loci{ and key ir. its possession to enter any and all gates on the vacated Dunham
alleyway.
3. Appurtenant. The easement granted herein shall benefit and be appurtenant to the City
of South Bend, Indiana and private utilities with facilities in the alley.
4. Easement Irrevocable. The wanting of this easement shall be irrevocable.

Access Easement Description
An access easement being a port of the west half of the southwest
quarter of Section 11, Township 37 North, Range 2 East,
City of South Bend, St. Joseph County, Indiana, described as
follows:
Beginning at the northwest corner of lot 18, Peck's 2nd Subdivision
of Part Bank Outlot 101 and 102, said corner being also the south
right of way line of a vacated alley, thence east along said south
right of way line, 65 feet to a point 3 feet east of the northeast
corner of lot 17, Peck's 2nd Subdivision; thence north parallel
to the east lot line of lot 8 in said Peck's 2nd Subdivision, 142
feet to the south right of way line of Dunham Street; thence
west along said south right of way line of Dunham Street, 12
feet; thence south parallel with said east line of lot 8, 120 feet;
thence southwesterly to the north right of way line of said
