EAST OF MAIN STREET, FOR A DISTANCE OF 165
FEET AND A WIDTH OF 14 FEET. PART OF THE
ORIGINAL PLAT OF SOUTH BEND, ST. JOSEPH
COUNTY, INDIANA; AND THE FIRST NORTH/SOUTH
ALLEY EAST OF MAIN STREET, FROM THE NORTH R/W
LINE OF THE FIRST EAST/WEST ALLEY NORTH OF
WAYNE STREET, TO THE SOUTH R/W LINE OF
JEFFERSON BLVD. FOR A DISTANCE OF 198 FEET AND
A WIDTH OF I4 FEET. PART OF THE ORIGINAL PLAT
OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12, the Common Council
is charged with the authority to hear all petitions to vacate
public ways or public places within the City.
The following Ordinance vacates the above described public
property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend
having held a public hearing on the petition to vacate the
following property:
THE FIRST EAST/WEST ALLEY NORTH OF WAYNE STREET, FROM THE EAST R/W
OF MAIN STREET TO THE WEST R/W OF THE FIRST NORTH/SOUTH ALLEY EAST
OF MAIN STREET, FOR A DISTANCE OF 165 FEET AND A WIDTH OF 14 FEET.
PART OF THE ORIGINAL PLAT OF SOUTH BEND, ST. JOSEPH COUNTY,
INDIANA; AND THE FIRST NORTH/SOUTH ALLEY EAST OF MAIN STREET, FROM
THE NORTH R/W LINE OF THE FIRST EAST/WEST ALLEY NORTH OF WAYNE
STREET, TO THE SOUTH R/W LINE OF JEFFERSON BLVD. FOR A DISTANCE OF
198 FEET AND A WIDTH OF 14 FEET. PART OF THE ORIGINAL PLAT OF SOUTH
BEND, ST. JOSEPH COUNTY, INDIANA
Hereby determines that it is desirable to vacate said property.
SECTION II. The City of South Bend hereby reserves the rights
and easements of all utilities and the Municipal City of South
Bend, Indiana, to construct and maintain any facilities, including,
but not limited to, the following: electric, telephone, gas,
water, sewer, surface water control structures and ditches, within
the vacated right-of-way, unless such rights are released by the
individual utilities.
SECTION III. The following property may be injuriously or
beneficially affected by such vacating:

LOT NUMBER 18-3007-0242
SECTION IV. The purpose of the vacation of the real property
is the maximization of security at the Robert A. Grant Federal
Building & U.S. Courthouse.
SECTION V. This ordinance shall be subject to the first
condition set forth in a letter dated November 13, 2000 from the
Board of Public Works which is on file in the Office of the City
Clerk. Said ordinance shall be further subject to the filing of
written agreement(s) addressing ingress and egress between the
petitioner and the property owners of the properties with key
numbers

with the City Clerk on or before December 13, 2000, and all such
agreements being duly recorded in the St. Joseph County Recorder's
Office.
SECTION VI. This ordinance shall be in full force and effect
from and after its passage by the Common Council, and approval by
the Mayor.

Respectfully report that they have examined the matter and that in their opinion, this bill is being
recommended to the full Council with a favorable recommendation as amended as follows;
renumber Sec. V to Sec. VI. New Sec. V shall read as follows:
This ordinance shall be subject to the first condition set forth in a letter dated November 13, 2000
from the Board of Public Works which is on file in the Office of the City Clerk. Said ordinance
shall be further subject to the filing of written agreement(s) addressing ingress and egress
between the petitioner and the property owners of the properties with key numbers, 18-3007-
0236, 183007-0249, 18-3007-0239, 18-3007-0247, 18-3007-0242 and 18-3007-0248 with the
City Clerk on or before December 13, 2000, and all such agreements being duly recorded in the
St. Joseph County, Recorder's Office.

Building in downtown South Bend. It is necessary for the United States to control access
to the alleys to maximize security at the Federal Building.

RE: Alley Vacations
Dear Members of the Council:
In accordance with Municipal Code Section 18-53.8, a favorable recommendation is being submitted
to the Common Council concerning an alley vacation.
The first east/west alley north of Wayne Street, from the east R/W of Main Street to the west R/W of
the first north/south alley east of Main Street, for a distance of 165 feet and a width of 14 feet. Part
of the original plat of South Bend, St. Joseph County, Indiana; and the first north/south alley east of
Main Street, from the north R/W line of the first easthvest alley north of Wayne Street, to the south
R/VV line of Jefferson Boulevard for a distance of 198 feet and a width of 14 feet. Part of the original
plat of South Bend, St. Joseph County, Indiana.
For your information, the Board of Public Works received favorable recommendations from the Fire
Department, Bureau of Sanitation, Division of Engineering, Department of Community and Economic
Development, Area Plan Commission and the Police Department concerning this vacation, subject to any utility
easements that may be required. Community and Economic Development submitted a favorable
recommendation, contingent upon the following: 1) adjacent buildings still have service access, now and
for future users; 2) development plans for the Main/Jefferson office building may require an approved
elevator and stairwell at the northwest corner of the AMPCO parking deck, which could require the use
of part of the proposed vacated alley. Area Plan stated the vacations will need to be subject to a turning
radius easement at the intersection of the north/south alley and east/west alley for alley traffic from the
south.
Therefore, the Board submits to you a favorable recommendation concerning this vacation, subject
to the above..
