AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT 530 NORTH LAFAYETTE BOULEVARD
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of South Bend, Indiana:
SECTION 1. Ordinance NO. 4990-68, as amended, which ordinance is commonly known as the Zoning
Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning
classification of the following described real estate in the City of South Bend, Indiana, St. Joseph County, State
of Indiana:
Lot 187, Lot 188, Lot 189, Lot 190, except the South 28.5 feet, Lot 194, except the South 30 feet,
Lots 195, 196, 197 and 198 and the vacated 14 foot alley beriveen portions of said Lots, all as
shown on the recorded Plat of the original plat of South Bend, Indiana, described as follows:
Beginning at the Northeast corner of said Lot 187, said corner being the Southwest intersection
of Main Street and Navarre Street; thence West along the South line of Navarre Street, 344 feet
to the East line of Lafayette Boulevard; thence South along said East line of Lafayette Boulevard,
314 feet to a point 30 feet north of the South line of said Lot 194; thence East parallel with said
South line of Lot 194, 165 feet to the West line of a 14 foot public alley; thence North along said
West line of public alley, 215 feet to a point 99 feet South of the South line of Navarre Street;
thence East along the South line of the North '/z of the Westerly extension of Lot 188, 14 feet to
the Est line of said Lot 188; thence South along said West line 150.5 feet to a point 28.5 feet
North of the South line of said Lot 190; thence East parallel with said South line of Lot 190, 165
feet to the West line of Main Street; thence North along said West line of Main Street, 249.5 feet
to the point of beginning.
Together with:
Beginning on the West line of Lot 190 as shown on the plat of the original town, now City of
South Bend, Indiana, at a point 28.5 feet North of the Southwest corner of said Lot 190; thence
West parallel to the South line of said Lot 190, a distance of 14.00 feet to the East line of Lot 195
in said original plat; thence North on the East line of said Lot 195 and said line extended North,
and the East Lines of Lots 196 and 197 in said original plat, a distance of 150.57 feet; thence
East on the Westerly extension of the Sotlth line of the North '/ of Lot 188 in said original plat, a
distance of 14.00 feet to the West line of Lot 188; thence South on the West line of said Lot 188,
Lot 189 and said line extended South and the West line of Lot 190 in said original plat, a
distance of 150.57 feet to the point of beginning.
Be and same is hereby established as "C" Commercial, "g" Height and Area.
SECTION II. This ordinance shall be in full force and effect from and after its passage by the Common Council,
approval by the mayor, and legal publication.

Petition to Rezone
I (we) the undersigned make application to the Common Council of the City of South Bend, Indiana to
amend the zoning ordinance as herein requested.
1) The property sought to be rezoned is located at:

4) It is desired and requested that this property be rezoned
from "C" Commercial, "g" Height and Area
to "C" Commercial, "g" Height and Area
5) This rezoning is requested to allow the following uses(s):
Expansion of building from Two Floors to Seven Floors for medical laboratory business
6) Attached is a copy of the (a) legal description of the property; (b) a list of names and address of all property
owners within 300 feet of the petition property; and (c) six (6) site plans; and (d) addressed, stamped
envelopes for all property owners within 300 feet of the petitioned property.
7) By signing this petition, I and any contingent purchaser understand that if the Council approves this petition
to rezone, it may be approved subj ect to the submittal of a final site plan. A final site plan must be submitted
to and approved by the Area Plan Commission within one (1) year of the Council's action. In addition, a
building permit must be issued for the use indicated on the petition within one year following the approval
of the final site plan. Failure to submit a final site plan or obtain a building permit within the specified time
period, causes the zoning of the petitioned property to revert to the initial zoning classification. Under
certain conditions, a time extension on the~ubmittal of the final site plan mad be requested.

from "C" Commercial, "G" height and Area to "~" Commercial, "G" Heigght and Area, property
located at 530 N. Lafayette Boulevard, City of South Bend - APC #2018-00
Dear Council Members:
The above referenced ordinance and site development plan of South Bend Medical Foundation was
legally advertised September 7, 2000. The Area Plan Commission at its public hearing on
September 19, 2000, took the following action:
Upon a motion by Gerr Phippps, being seconded by Karl King and unanimously carried, the
~ro~posed ordinance an~site develo went plan of South Bend Medical Foundation to zone from
C' Commercial, "G" Height and Area to "C" Commercial, "G" Height and Area, property .
located at 530 N. Lafayette Boulevard, City of South Bend is-sent to the Common Council with a
favorable recommendation, sub'ect to a final site development plan. This rezoning would allow
an addition to the existing buil~ing which would be in keeping with the character of the adjacent
hospital facility.
The deliberations of the Area Plan Commission and points considered in arriving at the above
decision are shown in the minutes of the public hearing, and will be forwarded to you at a later
date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the Area Plan
Commission's Staff Report.

Location: 530 N. Lafayette Boulevard
City of South Bend
REQUESTED ACTION: The petitioners are requesting a zone change
' from "C" Commercial, "G" height and Area to
"C" Commercial, "G" Height and Area to allow
the expansion of an existing building for
laboratories and offices.
EXISTING LAND USE: The property currently contains the South Bend
Medical Foundation building.
SURROUNDING LAND USE AND ZONING: Located to the north and east is the Memorial
Hospital property zoned "B" Residential and
"C" Commercial; to the south are single family
homes and offices zoned "B" Residential; and
to the west are single family homes zoned "A"
Residential and single family homes and
offices zoned "B" Residential.
ACCESS: Access to the site is from both Main Street
and Lafayette Boulevard.
WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site.
DRAINAGE: The drainage has not been addressed by the
petitioner.
SITE DATA: The total site to be rezoned is 2.2 acres. Of
that, the buildings will occupy 36,290 square
feet, or 37 percent of the site; the parking
and drives will occupy 1.2 acres, or 55
percent of the site; and 6,822 square feet or
7 percent of the site will remain as open
space.
ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no
public wells, flood hazards, wetlands or
environmental hazard areas are present.
SITE PLAN: The site plan is preliminary.
AGENCY COMMENTS: The City Engineer will require a drainage plan
at the final site plan stage. This property
was approved to be rezoned from "B"
Residential "G" height and are to "C"
Commercial "G" height and area on December 13,
1999 by the Common Council. The final site
plan that was approved on March 3, 2000 did
not show the presence of seven floors.
Therefore, it was determined that seven floors
would be considered a major change to the site
plan and would require a rezoning from "C"
Commercial to "C" Commerial.
PRELIMINARY
STAFF RECOMMENDATION: Based on information available prior to the
public hearing, the staff recommends that this
petition be sent to the Common Council with a
favorable recommendation, subject to a final

be in keeping with the character of the
adjacent hospital facility.
