AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA, AMENDING VARIOUS SECTIONS WITHIN CHAPTER 21, ARTICLE 2,
DIVISION 7, "C" COMMERCIAL DISTRICT REGULATIONS,
OF THE SOUTH BEND MUNICIPAL CODE TO ADD ZONING DISTRICTS TO THE
LOCATIONAL REQUIREMENTS OF ADULT USES
STATEMENT OF PURPOSE AND INTENT
The purpose of this ordinance is to amend Chapter 21 of the South Bend Municipal
Code to add to the list of those use districts in which there is a distance restriction between adult
businesses and these districts.
The Common Council of the City of Soutli Bend recognizes its duty to enact zoning
ordinances to promote the general health, welfare and safety of residents of the City of South Bend.
The Common Council further recognizes that providing for an adequate amount of space
between certain types of uses will promote the general health, welfare and safety, enhance the quality
of life for the residents of the City of South Bend, and decrease the potential of blight and the
disruption of the quiet enjoyment of commercial and residential property.
Now, Therefore, be it ordained by the Common Council of the City of South Bend, Indiana,
as follows:
Section I. Chapter 21, Article 2, Division 7, Section 21-18 (d) (A) be amended by adding the
following:
(12) "IP" Industrial Park
Section II. Chapter 21, Article 2, Division 7, Section 21-18 (d) (B) be amended by adding
the following:
(5) "A"Agricultural District
(6) "O" Office District
(7) "OB" OfficeBusiness District
(8) "B"Business District
Section VI. This Ordinance shall be in full force and effect from and after its passage by the
Common Council and approval by the Mayor.

RE: Area Plan Commission Initiated Petition to Amend the Zoning Ordinance to Add
Zoning Districts to the Location Requirements of Adult Uses
Dear Ms. Pfeifer:
Attached is a proposed ordinance that was initiated by the Area Plan Commission. The
purpose of this ordinance is to add zoning districts to the location requirements of adult
uses. This ordinance is necessary because of the new zoning districts that have been
adopted by the City and the County.
Please place this proposed ordinance on the August 14, 2000, Common Council agenda
for first reading. We anticipate that the Area Plan Commission will hear this ordinance
on September 19, 2000.

Dear Council Members:
The above referenced ordinance initiated by the Common Council was legally advertised
on September 7, 2000. The Area Plan Commission at its public hearing on September 19,
2000, took the following action:
Upon a motion by John McNamara, being seconded by Karl King and unanimously
carried, the proposed ordinance initiated by the Area Plan Commission of St. Joseph
County, Ind><ana, amending various sections within Chapter 21, Article 2, Division 7, "C"
Commercial District Regulations, of the South Bend Municipal Code to add zoning .
districts to the locational requirements of Adult Uses, is sent to the Common Council with
a favorable recommendation.
The deliberations of the Area Plan Commission and points considered in arriving at the
above decision are shown in the minutes of the public hearing, and will be forwarded to
you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the Area Plan
Commission's Staff Report.
