AN ORDINANCE AUTHORIZING THE DONATION OF LAND TO AID IN THE ERECTING OF AN ARMORY IN THE CITY OF SOUTH BEND , WHEREAS, due to the construction and reconstruction of the Sample Street Bridge, it has been necessary for the State Armory to plan removal of their facilities to another location, and WHEREAS, due to the construction and reconstruction of the Sample Street Bridge, it is necessary for the United States Naval and Marine Corps Training Center to contemplate removal to another area in the City of South Bend, and WHEREAS, the site presently occupied by the State Armory is to be utilized by said Sample Street project, and WHEREAS, the site occupied by the United States Naval and Marine Corps Training Center is to be utilized by the Sample Street project, and WHEREAS, in exchange for said sites being made available for the Sample Street project construction and reconstruction, the City of South Bend, has agreed to grant and donate land for a site to be used by said State Armory, and, if desired, by the United States Naval and Marine Corps Training Center, and WHEREAS, there is a separate agreement pending between the State Armory Board and the District Public Works Office Ninth Naval District of Great Lakes, Illinois, for a joint facility on said proposed site, and WHEREAS, under the Acts of 1953, Chapter 187, Section 214, page 660 as amended in 1955, Chapter 75, Section 3, page 145 of the General Assembly, also known as Burns Indiana Statutes, Section 14 -1914, the State Armory Board has the power to receive from cities, donations of land to aid in erecting an Armory for the use of the Armed Forces of Indiana, and the cities of the State of Indiana are authorized to make such contributions, NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. That the Mayor of the City of South Bend be author- ized to execute by Warranty Deed a conveyance of the below described property to the State of Indiana, for its use in the erection of an Armory, to -wit: A part of the East half of the South West Quarter of Section No. 14, Township No. 37 North, Range No. 2 East, in the City of South Bend, which part is bounded by a line running as follows, viz: Beginning at a point on the South line of Bruce Street, as dedicated, in the City of South Bend, 30 feet West of the North and South center line of said Section No. 14, said point being on the West line of Kemble Avenue in said City; thence South on the West line of Kemble Avenue 900. 31 feet to a point 25 feet North of the South line of Donald Street as dedicated; thence Westerly on a line parallel with and 25 feet North of the South line of said Donald Street, 1289. 36 feet to a point 20 feet East of the West line of Webster Street, as dedicated, in the City of South Bend; thence Northerly on a line parallel with and 20 feet East of the West line of said Webster street, 899. 65 feet to the South line of Bruce Street; thence East on said South line 1288.40 feet to the place of beginning, containing 26. 629 acres, more or less; excepting a strip of land 30 feet in width, East and West, off of the entire West end thereof, to be used as a part of Webster Street, between Bruce Street and Donald Street, and another strip of land 25 feet in width, North and South, off of the entire South end of said tract, to be used as a part of Donald Street between Kemble Avenue and Webster Street, in the City of South Bend, as shown by Dedication dated December 13th, 1944, recorded August 9th, 1945, in Miscellaneous Record 84, pages 394 and 395 in the office of the Recorder of St. Joseph County, Indiana; -2- Except that the City of South Bend retains the. following described real estate, to -wit: A strip of land ten (10) feet wide, East and West, taken off of the entire East end of said tract, to be used as a part of Kemble Street between Bruce Street and Donald Street, and another strip of land Eighty (80) feet wide, North and South through the entire tract from Kemble Street to Webster Street and centered on the center line of Calvert Street extended, to be used for the extension of Calvert Street through said tract, in the City of South Bend. It is further authorized that said Deed shall carry a reversionary clause that in the event the State of Indiana does not use the said above described premises for an Armory within a period of five (5) years from date, then all of said real estate shall revert to the City of South Bend. SECTION II. This Ordinance shall be in full force and effect from and after its passage by the Common Council, its approval by the Mayor and the fulfillment of all statutory requirements relating thereto.
