INTENT The purpose of this ordinance is to amend Chapter 21 of the. Municipal Code to modify the regulations regarding outdoor advertising signs. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section 1. Section 21.170 of Article 10 Chapter 21 of the South Bend Municipal Code is amended to read as follows: Sec. 21.170.(6) "C" Commercial, "D" Light Industrial, and "E" Heavy Industrial Districts: (d)(1) The maximum display area of outdoor advertising signs located on arterial streets, as established in the Lonct Range Transportation Plan as determined by the Michiana Area Council of Governments, and limited access highways, shall be , .--'-_~ ~ __'---_--`_ six hundred seventy-two (672) square feet. Two tiered, deck or stacked signs shall be prohibited. The maximum display area of outdoor advertising signs located on collector streets, as established in the Long Range Transportation Plan as determined by the Michiana Area Council of Governments, shall be three hundred (300) square feet. t-~-a~rtPi3-t-1~ -_L_, , _ sr~~rs , . Temporary extensions may be added to individual signs based on individual advertising requirements not to exceed 200 square feet per face (a maximum of 872 square feet with extensions). (d)(2) The backs of outdoor advertising signs shall be concealed by another outdoor advertising display, shall be screened by suitable architectural treatment, or shall be painted to blend with the surroundings and kept so painted. (d)(3) Empty boards and signs without advertising covering the entire face of the board shall be prohibited. {~--(~-}(d) (4)The maximum height of outdoor advertising signs shall be thirty-five (35) feet; ~ ,-; ~t~~rrn---wrlr 'rra--o-~rrer--y~rs~-rest-,--rr=;--iTrr ~(d)(5)The required side yards and setback for outdoor advertising signs shall be as established for height and area district in which the sign is located. ) (d) (6) The minimum distance between a new outdoor advertising sign and an existing outdoor advertising sign 1_______'_ on the --- es-eof the street shall be seven hundred fifty feet (7501) on both sides of the street along the right -of -way. The minimum separation distance between an outdoor advertising sign and the nearest boundary of a residential district, historic preservation district, public park, residential use, church, school, designated historic landmark or river shall be 200 feet along both sides of the street from which the sign is intended to be viewed. }(d)(9)The total number of outdoor advertising signs within the associated sphere of influence shall at no time exceed the total number of outdoor advertising signs legally in existence in said area on the effective date of Ordinance No. 5647-74. (d)(10) Separation distances shall not be limited by jurisdictional boundaries. Required separation distances for proposed signs located within the jurisdiction of the City of South Bend shall also be maintained from signs located in adjacent municipalities or jurisdictional area. Section 2.
