L16, 6v _, - 5Z AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA AS AMENDED BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1: That Section 1, Definitions, of Ordinance No. 3702, (as amended), commonly knowE/ as the Zoning Ordinance of the City of South Bend, Indiana be amended by the additinn thereto of the following definitions: 1. DWELLING UNIT - a building or a portion thereof designed or 1. 2. arranged to provide living facilities for a single family. 2. 3. Each "dwelling unit" shall contain permanently installed 3. 4. kitchen and toilet facilities. 4. 5. 5. 6. 6. 7. FLOOR AREA - The "floor area" of a building shall be taken to 7. 8, be the sum of the gross areas of the several floors of the 8. 9. building, measured from the exterior faces of exterior walls 9. 10. or from the centerline of common walls. "Floor Area" shall 10. 11. include floor openings for stairwells, elevator shafts, and 11. 12. duct work, floor space used for mechanical equipment, open 12. 13. or enclosed, penthouses, attic space having headroom of seven 13. 14. feet -ten inches (7' -10 ") or more, interior balconies, mezzanines 14. 15. and enclosed porches, and covered floor areas devoted to 15. 16. accessory uses. Basement floor area shall be included when 16. 17. more than one -half (112) of the basement height is above 17. 18. finished grade or when utilized as a dwelling unit or for 18. 19. commercial or industrial purposes. "Floor Area" shall not 19. 20. be included when used for off - street parking or unloading. 20. 21. 21. 22. GROSS ACREAGE - all lands and open spaces included in a tract, 22. 23. and one half (112) of all abutting streets, alleys and utility 23. 24, easements. 24. 25. 25. 26. PLANNED RESIDENTIAL DEVELOPMENT - a tract of land under single 26. 27. ownership or control, which is to be developed as a unit, 27. 28. according to an overall development plan and which complies 28. 29. with the intent and requirements of this ordinance regarding 29. 30. such developments. 30, 31. 31. Page 2 OFF- STREET PARKING SPACE - a suitably surfaced area provided for the off-street parking of vehicles. Such "spaces" shall be a useable area containing a minimum of two hundred (200) square feet, having least dimensions of approximately nine (9) feet by twenty (20) feet, and shall be adequately surfaced, drained, screened, and landscaped. Aisle, access, or maneuvering space shall not be included in the minimum useable area. USEABLE OPEN SPACE - those spaces useable for outdoor recreational living an Ouse old uses normally carried on out doors; which are not devoted to non - household uses, vehicular use or parking; which are open to the sky; which, if above grade, are structur- ally sound and adequately surfaced and protected; and which are accessible to all occupants of the dwelling unit or units for whom the space is required. Section 2. This Ordinance shall be in full force and effect from and after its enactment, approval by the Mayor and legal publication.
