AN ORDINANCE ESTABLISHING A SCHEDULE OF
RATES AND CHARGES FOR SERVICES RENDERED
BY THE WATER WORKS SYSTEM OF THE CITY
OF SOUTH BEND TO AREAS OUTSIDE THE SOUTH
BEND CITY LIMITS.
W:: REAS, the Common Council of the City of South Bend finds
that r;r--Yision should be made for the extension of transmission
mains through undeveloped or unpopulated areas, not requiring or
seeking service, to an area outside the South Bend City Limits,
by a developer, a prospective permanent consumer, or a group of
prospective permanent consumnxs,and that the extension of services
to such areas is necessary to the development and expansion of
such areas and to properly protect the health, well -being and
property of such areas and their inhabitants, and will benefit the
general welfare of the inhabitants of the said city; and,
the Water Works of the City of South Bend would
incur the cost and investment of the construction of said trans-
mission m4sns to the outlying areas, and said Water Works would
install and maintain fire hydrants and provide water for fire
protection to said areas; and,
WHEREAS, there are no water rates or charges established
for service to said areas, and the City Council now finds that
rates and charges should be established; now therefore,
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
SECTION I. That there shall be and there is hereby estab-
lished for use of the service rendered by the Water Works System
of the City of South Bend to consumers outside the City Limits of
South Bend the following rates and charges:
(a.) For consumers outside the City Limits whose water is
supplied by the Water Works by means of the extension of a trans-
mission main the rates and charges shall be equal to such rates
and ch >.rges as are established for consumers within the City of
South Bend plus fifty percent (50%) thereof for a period of
ten (10) y-ars after service is first supplied to such consumers.
and after such ten (10) year period the rates and charges shall
be equal to such rates and charges as are established for con-
sumers within the City of South Bend plus twenty percent (20%)
thereof.
(b.) For consumers outside the City Limits whose water is
supplied by the Water Works without a transmission main being or
having been extended, the rates and charges shall be equal to
such rates and charges as are established for consumers within
the City of South Bend plus 20% thereof.
SECTION II. The rates and charges established by this
Ordinance shall not apply to persons who are being supplied water
by the Water Works of the City of South Bend at the time of the
effective date of this Ordinance.
This Ordinance shall be in full force and effect from and
after its adoption and approval by the Mayor, and at such time
as the rates and charges established herein are approved by the
Indiana Public Service Commission or at such time as said
Commission shall direct.
