The alley to be vacated is the first North/South alley West of Kaley Street from the North right of way line of Marquette Blvd. to a point 20 feet South of the North lot line of lot 459 for a distance of 260 feet, being a part of Vernon Heights Addition to the City of South Bend, Indiana STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: The street to be vacated is a portion of Eclipse Place beginning at the South lot line of lot 464 and continuing North to a point 20 feet north of the North East line of lot 460 for a distance of 220 feet, being a part of Vernon Heights Addition to the City of South Bend, St. Joseph County, Indiana. The alley to be vacated is the first North/South alley West of Kaley Street from the North right of way line of Marquette Blvd to a point 20 feet South of the North lot line of lot 459 for a distance of 260 feet, being a part of Vernon Heights Addition to the City of South Bend, Indiana Hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: LOT NUMBERS 433, 434, 435, 436, 437, 438, 439, 440, 441, 442, 443, 444, 445, 446, 455, 456, 457, 458, 459, 460, 461, 462, 263, 464, 465, 466, 467, 468 all within said Vernon Heights Addition SECTION IV. The purpose of the vacation of the real property is to be able to replat a number of individual lots into 1-3 new lots. The 1-3 lots would facilitate the construction of a church, a Recreation Facility, and a Parsonage. SECTION VI.
