AN ORDINANCE TO AMEND SECTION 17 -A OF ZONING
ORDINANCE NO. 3702 OF THE CITY OF'SOUTH BEND,
INDIANA.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AS FOLLOWS:
SECTION I. That Section 17 -A of the Ordinance No. 3702, being
the Zoning Ordinance of the City of South Bend,
Indiana, be amended to read as follows:
SECTION 17 -A
USE HEIGHT AND AREA DISTRICT EXCEPTIONS.
The provisions of this ordinance regulating the
use and height and area of lands, building and occupancies
shall not apply to lands, buildings and occupancies which
are publicly owned, or to parochial schools.
The exclusion does not apply to lands, building or
occupancies purchased or constructed for public housing
under Federal, State or Local grants to be available for
use or occupancy as personal housing or dwelling.
SECTION II. This Ordinance shall be in full force and effect
from and after its adoption by the Common Council
of the Civil City of South Bend, Indiana, and
approval by the Mayor.

The attached petition of the Common Council to amend
Section 17 —A of Ordinance No. 3702, the Zoning Ordinance
of the City of South Bend, Indiana was legally advertised
under date of of January 16, 1964 and given public
hearing on January 27, 1964. The following action was
taken:
After due consideration it was duly moved,
seconded, and unanimously carried that the
following resolution be adopted:
BE IT RESOLVED, that the Planning Commission finds:
1. That the proposed amendment to the Zoning
Ordinance would under ordinary circumstances
be a desirable amendment.
2. That one of the purposes of the Zoning
Ordinance is to promote the general
welfare of the City.
3. That the proposed amendment if adopted at
the present time would prohibit the use of
certain areas for the purposes for which
the City is presently committed to use such
areas.

4. That in the opinion of the Commission the
adoption of the proposed amendment at the
present time would not promote the general
welfare of the City.
THEREFORE BE IT FURTHER RESOLVED, that the Commission
recommends said proposed amendment to the Common
Council unfavorably.
