Cottrell, and Jack Reed present. Board Member Bruce J. BoiiDurant was absent. Also present were Police Chi-.--,,f' Darryl Boykins, Fire Chief Howard Buchanon and Board Attorney Thomas Bodnar. Cottrell, Member ATTEST: M Martift; Clerk­_ EXECUTIVE SESSION OCTOBER 1-,- 2004 The Board of Public Safety met in Executive Session on Wednesday, October 1, 2008, at 8:40 a.1 n. The meeting was held in the Mayor's Conference Room, 10' Floor, County City Building, South Bend, Indiana, for the purposes specified in I. C. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (A). President Donal-d Alford and Board Members Juanita Dempsey, Donald Alford, Patrick Cottrell, and E. Jack Reed were present. Board Member Bruce J. Bon Durant was absent. Also present were Police Chief DarrylBoykins, Fire Chief Howard Buchanon, and Board Attorney Thomas Bodnar. Harting -- Clerk REGULAR MEETING The Board of Public Safety met in the regular meeting at 9-18 a.m. on Wednesday, October 1, 2008, with President Donald Alford and Board Members Juanita Dempsey, Patrick D. Cottrell, and E. Jack Reed. present. Board Member Bruce J. Bon Durant was absent. Also present were Po B lice Chief Darryl Boykins, Fire Chief Howard uchanon, and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, l3t" Floor, County City Building, South Bend, Indiana. ACCEPT MINUTES OF PREVIOUS MEETINGS Pl.-Csident Alford advised that if there were no objections by members of the Board, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held on September 10, 2008, would be accepted with Ms. Dempsey's noted correction to the Adjouriu-nent section of the Public Agenda Session. ACCEPT AND FILE DONATION TO SOUTH BEND POLICE DEPARTMENT In. a letter to the Board, Chief Boykins, Police Department, advised the Board of a generous donatio of twenty dollars ($20.00) made to the South Bend Police Department Youth Boxing Program from private citizen. There being no further discussion, the donation was accepted and -file] NAMINTIWIWN� On September 24, 2008 Sergeant Mark Szweda was found guilty of operating a vehicle while intoxicated in violation of IC 9-30-5-2(b), a Class A misdemeanor in the Ell�hart County Superior Court No. 4,, Cause Number 20D04-0808-CM-00408. Such conduct violates IC 36-8-3-4(b)(I) r 'MOKIW11 On August 4, 2008 Sergeant Mark Szweda, a member of the South Bend Police Department, while off duty in the vicinity of Market and Rosenberger Streets, Nappanee, Indiana operated a motor 11) vehicle while intoxicated, Said conduct violates IC 36-8-3-4(b)(2), Rules 302.00(A)(1), of the South Bend Police Department Duty Manual, and IC36-8-3-4(b)(2)(B) and (H). Chief Boykins recommended that Sergeant Szweda be suspended from duty without pay for tweiitly,- one (2 1) calendar days. In addition to the suspension from duty, the Chief also will impose a two year loss of his tak-e home vehicle which will be reduced to one year of official use only of the take home car after successfid completion of an Alcohol Program. This official use only of his take horne car privileges will begin immediately. Upon a motion by Mr. Cottrell, seconded by Ms. Dempsey and carried, the Board accepted the charges for filing and instructed the Clerk to prepare a letter to serve the Charges on Sergearl Szwedal, and a Notice of Special Meeting on October 8, 2008 regarding the Charges.
