AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND APPROPRIATING $150,000 FROM THE
SELF-INSURANCE FUND (FUND N0.226)
STATEMENT OF PURPOSE AND INTENT:
In order to finalize settlement of pending cases, an additional appropriation from the Self-
Insurance Fund (Fund No. 226) is needed. The additional sum of $150,000 from the. Self-
Insurance Fund will permit the settlement and finalization of outstanding litigation which
culminated during the calendar year 2000.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I: The sum of $150,000 is hereby appropriated from the Self-Insurance Fund
(Fund No. 226) for the payment of settlements to conclude outstanding litigation which has
concluded during the calendar year 2000.
Section II: This ordinance shall be in full force and effect from and after its passage by the
Common Council and approval by the Mayor.

Re: Additional Appropriation from the Self-Insurance Fund
Dear President Pfeifer:
Attached for the Council's consideration is an ordinance appropriating from the Self-
Insurance Fund the additional sum of $150,000. The Legal Department's settlement of claims
and payment of judgments on behalf of the City is, by nature, imprecise and unpredictable. In
calendar year 2000 the City was assessed an unexpected judgment and presented with claims that
it had not anticipated.
Overall, the City's payment of claims in calendar year 2000 has been financially beneficial
to the City on a case-by-case basis, but our projections were skewed by an unexpected number of
high damage cases.
Thank you for your favorable consideration of this ordinance.
