AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY:
THE FIRST NORTH/SOUTH ALLEY EAST OF DALE AVENUE FROM THE NORTH
RIGHT OF WAY LINE OF MILTON STREET TO THE FIRST EAST/WEST ALLEY
FOR A DISTANCE OF 120 FEET; THE FIRST NORTH/SOUTH ALLEY EAST OF
DALE AVENUE FROM THE SOUTH RIGHT OF WAY LINE OF DAYTON STREET TO
THE FIRST EAST/WEST ALLEY FOR A DISTANCE OF 120 FEET; THE FIRST
EAST/WEST ALLEY NORTH OF MILTON STREET FROM THE EAST RIGHT OF WAY
LINE OF DALE AVENUE TO THE SECOND NORTH/SOUTH ALLEY FOR A
DISTANCE OF 240 FEET. ALL BEING A PART OF SOUTH EAST ADDITION TO
THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY,. INDIANA
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12, the Common
Council is charged with the authority to hear all petitions to
vacate public ways or public places within the City.
The following Ordinance vacates the above described public
property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend
having held a public hearing on the petition to vacate the
following property:
1. The alley to be vacated is the first north/south alley east
of Dale Avenue from the north right of way line of Milton
Street to the first East/West alley for a distance 120 feet.
Being a part of South East Addition to the City of South
Bend, St. Joseph County, Indiana.
2. The alley to be vacated is the first north/south alley east
of Dale Avenue from the south right of way line of Dayton
Street to the first East/West alley for a distance of 120
feet. Being a part of South East Addition to the City of
South Bend, St. Joseph County, Indiana
3. The alley to be vacated is the first east/west alley north
of Milton Street from t e east right of way line of Dale
Avenue to the Second north/south alley for a distance of 240
feet. Being a part of South East Addition to the City of
South Bend, St. Joseph County, Indiana
Hereby determines that it is desirable to vacate said property.
SECTION II. The City of South Bend hereby reserves the
rights and easements of all utilities and the Municipal City of
South Bend, Indiana, to construct and maintain any facilities,
including, but not limited to, the following: electric,
telephone, gas, water, sewer, surface water control structures
and ditches, within the vacated right-of-way, unless such rights
are released by the individual utilities.
SECTION III. The following property may be injuriously or
beneficially affected by such vacating:

SECTION IV. The purpose of the vacation of the real property
is to permit the implementation of campus master plan
improvements and the replat of the Diocese of Fort Wayne/South
Bend St. Matthew Cathedral properties.
SECTION V. This ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor, and shall be subject to the petitioner providing
access to its property for a turning radius, if necessary, for
utilities who may need to access the vicinity of the "T" alley
for maintenance and public service purposes.

Respectfully report that they have examined the matter and that in their opinion, this bill is being
recommended to the full Council with a favorable recommendation as amended as follows:
Section V. This ordinance shall be in full force and effect from and after its passage by the
Common Council, approval by the Mayor, and shall be subject to the petitioner providing access

Re: Proposed Public Right-of--Way Vacation
Dear Members of the Common Council:
With completion of St. Matthew Cathedral School Campus Master Plan in September, 2000, areas of facility and
site expansion were identified. Further reinforced was the immediate need for site improvements such as secured
off-street parking and accessible drop off points to serve both the school and cathedral. The Diocese of Fort
Wayne -South Bend and Saint Matthew Cathedral School are preparing for the implementation of Phase one of
the Master Plan.
The Diocese recently acquired sufficient residential properties between Milton and Dayton Streets in preparation
for the implementation of the master plan. With clearing of acquired properties, the Cathedral will have attained
adequate area for planned expansion of Phase one-site improvements.
To facilitate Saint Matthew Cathedral School and the Diocese of Fort Wayne -South Bend with the replat of
recently acquired properties and the rapid continuation of properly planned site improvements imperative to the
Cathedral School, we request your consideration on the matters of proposed public right of way vacation as
presented herein. The Cathedral of Saint Matthew is committed to improving its current facilities and grounds,
along with future building renovations and additions. It is crucial that the Cathedral take initiative at this time to
ensure that it continues to provide its parishioners and students with the best possible facilities and the best
possible Catholic education.

RE: Property Vacation
Dear Members of the Council:
In accordance with Municipal Code Section 18-53.8, an unfavorable recommendation is being
submitted to the Common Council concerning a property vacation on the following:
That portion ofthe existing public rights ofway known as Western Avenue and Columbia Street being
apart of the recorded Plat of River Bend Addition to the City of South Bend also being a part of the
west half of Section 12, Township 37 North, Range 2 East and described as follows: On Western
Avenue, from a point approximately 650 feet southwesterly of Jefferson Boulevard; thence
northeasterly to Jefferson Boulevard; thence also on Columbia Street from a point approximately 350
feet southeasterly of Western Avenue; thence northwesterly to western Avenue.
Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition
from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic
Development and the Department of Public Works. Area Plan noted that the staff would not normally
recommend the vacation of rights ofway in a fashion that results in the dead ending of streets. However, the
traffic from both Columbia and Western will flow into the proposed Crowe Chizek campus area, which
provides adequate space to turn around if necessary. The vacation of these rights ofway makes sense as part
of the development of this area. It should also be noted that the closing of these rights of way will have an
effect on travel routes of both pedestrian and vehicles to and through do«mto~~n South Bend. For this reason,
it is recommended that prior to the vacation, studies be undertaken to help properly redirect both forms of
downtown traffic.
Therefore, the Board submits to you a favorable recommendation concerning this vacation.
