J� / '�� AN ORDINANCE AMENDING THE MUNICIPAL KATHRYN L. BLOUGH CODE OF THE CITY OF SOUTH BEND, Cm CLERK, SOUTH BEND, IND. INDIANA, 1962, AS AMENDED, ALSO KNOWN AS ORDINANCE N0. 4563, THE SUBDIVISION ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: That 1 Section 1: 2 3 That Section I -B of the Municipal Code of the City of 4 South Bend, Indiana, 1962 as amended, also known as Ordinance 5 No. 4563, be amended so that same shall be and read as follows: 6 7 B. Jurisdiction. 8 9 This ordinance shall apply to all subdivision of land 10 within the corporatedlimits of the City of South Bend, 11 Indiana, as now or hereafter established. 12 13 It shall be unlawful for any person to subdivide or 14 layout into lots any land within the City, except in 15 accordance with procedures and approvals as required 16 herein. 17 18 Section 2: 19 20 That Section II, H and I of the Municipal Code of the 2 1 City of South Bend, Indiana, 1962, as amended, also known 22 as Ordinance!No. 4563, be amended so that same shall be and 23 read as follows: 24 25 H. Subdivision - a division of land either by metes "and 26 bounds description or by plat, into two (2) or more 27 lots or parcels for the purpose, whether immediate or 28 future, of conveyance, transfer, improvement or sale; 29 provided, however, that a division of land for agri- 30 cultural purposes in parcels of more than ten (10) 31 acres, shall be exempted. The term subdivision shall 32 also include re- division of land. 33 34 I. Minor Subdivision - a division of land, over any 35 period of time, into two (2) or more lots or parcels, 36 not requiring any new streets, alleys, roads, or involving 37 the extension of any municipal facilities, and not 38 adversely affecting the development of the remainder 39 of the parcel or any adjoining property. 90 91 92 93 94 95 96 97 98 99 100 101 102 103 104 105 106 107 108 log 110 111 112 113 1 14 115 116 117 118 119 120 121 1 2e 123 124 125 126 127 128 129 130 131 132 133 134 135 136 137 138 139 140 -3- or some other similarly accurate base at a scale (preferably not less than 400 feet to the inch) to enable the entire tract to be shown on one sheet. 2. The sketch plat shall show the following information: a. A vicinity key map showing the entire subdivision and its relation to the surrounding area, b. Tract boundaries, C. Description of property, north point, date and scale, d. Significant topographic and physcial features, e. Names of the owners of adjoining property as disclosed by the most recent tax records, f. All streets, roads, alleys or streams within the area being subdivided and immediately adjacent thereto, g. Lot arrangement. Section 6: That Section IV of the Municipal Code of the City of South Bend, Indiana, 1962 as amended, also known as Ordinance No. 4563, be amended by the addition thereto of the following: C -1 Minor Subdivision Approval. 1. The Area Plan Commission shall consider the aonli- cation, sketch plat and minor subdivision without public notice and hearing. 2. After consideration by the Area Plan Commission and if classified and approved as a minor subdivision, the Area Plan Commission shall affix the Commission's seal upon the sketch plat with a certificate of approval signed by the President of the Commission and attested to by the Secretary of the Commission. Upon approval of the sketch plat and minor subdivision, one copy of the sketch plat will be retained by the Area Plan Commission; one copy will be filed with the Building Commissioner; one copy will be filed with the City Engineer; and two copies returned to the subdivider. In the event the sketch plat and minor subidivision is disapproved, the Area Plan Commission shall set forth its reason in its own records and provide the applicant with a copy. 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 88 89 -2- Section 3: That Section IV -B -1 and 4, of the Municipal Code of the City of South Bend, Indiana, 1962, as amended, also known as Ordinance No. 4563, be amended so that same shall be and read as follows: B. Application. 1. The subdivider shall submit a written application for a certificate of approval and five (5) copies of a pre- liminary plat, or sketch plat in the case of a minor subdivision, as defined in this ordinance, to the Executive Director of the Area Plan Commission. The application shall specify the intent of the subdivider with respect to land use, drainage, sewage disposal, and water supply. Where applicable, the application shall also specify the intent of the subdivider with respect to schools, recreation facili- ties, essential municipal services, and street improvement proposed by the subdivider; the application shall also specify any existing restrictions or intended restrictions on the property to be subdivided, as well as the expected date of its development. 4. At the time of filing an application for approval of the plat, the application shall be accompanied by a certified check, money order, or cash as follows: (a) Ten ($10.00) Dollars plus Twenty -five ($.25) Cents for each lot in the proposed subdivision, (b) Five ($5.00) Dollars Plus Twenty -five ($.25) cents for each lot in the proposed minor subdivision, such sums to be Plan Commission to cover the cost the proposed plat. Tentative approval shall be effective for a maximum period of twenty -four (24) months unless upon application of the subdivider the Commission grants an extension. If the final plat has not been submitted within this time limit, the preliminary plat must again be submitted to the Commission for approval. The attached ordinance amending the Municipal Code of the City of South Bend, Indiana, 1962, as amended, also known as Ordinance No. 4563, the Subdivision Ordinance of the City of South Bend, Indiana was legally advertised under date of February 5, 1966 and given public hearing on February 15, 1966. The following action was taken: After due consideration it was moved by Mr. Helvie, seconded by Mr. Lehman and unanimously carried that that ordinance be adopted and recommended favorably to the Common Council for their adoption. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report.
