I BEND, IND— AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF
A GIFT OF PROPERTY TO BE DONATED BY INDIANA
& MICHIGAN ELECTRIC COMPANY TO THE MUNICIPAL
CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the Municipal
City of South Bend, Indiana:
SECTION I: That the offer of Indiana & Michigan Electric
Company to give and donate to the Municipal City of South Bend,
Indiana exclusively for public purposes the dam across the St.
Joseph River in the North West Quarter (u) of Section No. 12, Town-
ship No. 37 North, Range No. 2 East, in the City of South Bend, St.
Joseph County, Indiana, together with the Hydro Electric Power
House and certain real estate and rights adjacent thereto as more
particularly described in the form of quit -claim deed and instru-
ment entitled "Agreement Accepting Gift" tendered for consideration
by the Common Council of the Municipal City of South Bend, Indiana
is in the public interests and that said offer and gift of said
property subject to the exceptions, reservations, covenants, agree-
ments and terms contained in said form of quit -claim deed and in-
strument entitled "Agreement Accepting Gift" is hereby accepted
on behalf of the Municipal City of South Bend, Indiana.
SECTION II: That the Mayor and City Clerk of the
Municipal City of South Bend, Indiana are authorized, empowered and
directed to execute and deliver said "Agreement Accepting Gift" and
to accept and record said quit -claim deed in order that all of the
exceptions, reservations, covenants, agreements and terms thereof
will be binding upon the Municipal City of South Bend, Indiana.
SECTION III: That this ordinance shall be in full force
and effect from and after its adoption by the Common Council and
its approval by the Mayor.
