Subject: Resolution 2482 -Setting Acquisition Price for 319 S. William Street Property
Date: October 13, 2008
Attached to this staff report is Resolutions 2482 which relates to property at 319 S. William Street within the
South Bend Central Development Area. The property is a vacant lot which had been used as a residential
use over thirty years ago. The property is immediately adjacent to the single family house that the
Commission recently purchased at 323 S William Street. The property was added to the South Bend Central
Development Area acquisition list by Resolution 2441 on March 28, 2008.
The parcels proposed for acquisition include the following:

Resolution 2482
The purpose of Resolution 2482 is to set the acquisition value for the property. The average appraised value
as determined by two qualified appraisers is 57,250.00. This value includes the vacant lot which is 48' x 121'
(5,808 SF) parcel. (See attached map)
Summary
Staff requests approval of Resolutions 2482. The purpose of the acquisition is twofold. First, it is for site
control. The Commission owns the adjacent parcel to the south and a Resolution was presented earlier
concerning the parcel to the north. The appraised value is reasonable and would allow for a better plan for
the reuse of the block. Second, acquisition of this parcel is important as it would prevent an "island' situation
where a use could be put on the block that would counter the activities planned for the site. The projected
reuse plan for the block is for proposed for new housing concepts and acquisition will allow for consistent site
control and planning within the context of the on-going Coveleski Park Planning effort.

and in furtherance of the South Bend Ccnh al Dc~~clopmcnt urea Plan (`Plane). the South
Bend Redevelopment Commission ('~Connnission~~) has determined that it is necessary to
acquire unencumbered fee simple interest in certain propcrtics located ~-vithin the area
heretofore designated as the South Bend Central De~~clopmcnt Area (the ".nrea~~) ~~~ithin
the City of South Bend, Indiana (the "Cit~~~). ~~~hich properties are more particularly
dcscribcd at Exhibit A attached hereto and incorporated herein (the "Propertics~~): and
WH;=REAS. on Mardi ?8. ?008. the Commission adopted Res<~lution No. ?441
amending the Plan and adding the propcrtics to the nrea~s acyuisition list: and
WHEREAS. t~~~o (?) independent appraisals of the propcrtics ha~~c been
obtained in accordance ~~ ith Indiana ('ode ~ ~6-7- 14-19(h). ~e°hich pro~~ide the oticrin~a

WHEREAS, the Commission no~~ desires to authorize the staff of the
Commission to proridc and negotiate an offer for the Purchase of the propcrtics in
accordance with Indiana Code ~ ~G-7-1=3 19. ~~hich may include the acquisition of an
option and the Conu»ission~s pa~mcnt of cspcnses incidental to the com~c~ancc and
determination of the title of the propcrtics: and
WHEREAS, the Commission finds that all procedures necessary for authorizing
and acquiring the propcrtics have been completed in accordance ~~~ith Indiana la~~~;
NOw'. THEREFORE. BE Il~ RESOLVED by the South Bend Rcdevclopmcnt
Commission That:
1 . The state of the Commission arc hcrebv authorized and directed to cause a
purchase offer to be nuuic in writing to the o~~°ner(s) of the Properties as dcscribcd at
Exhibit A at the Oftcring Price (the ";1~cra~~c ~~cyuisition Price~~ in I-:~hibit ~1) in
accordance Frith Indiana Code ~ ~6-7 14-19, ~~~hich offer or process may include the
acquisition of an option for the lxuchase price and the payment of expenses incidental to
the com~cyancc and determination of the title of the propcrtics.
?. ~I~hc Commission's atwrnc~ is hcrcb< authorized and directed to nc~~otiatc
and prepare documentation necessary to accomplish the acquisition of the Properties in
accordance ~~~ith this Resolution and in a form acceptable to Icgal counsel.
~. No representations, contract or understanding relative to the purchase of
the Properties, ~-vhethcr made by a Commissioner, anployce or other agent or official. is
bindin~~ against the Commission wltil appro~~cd and accepted by the Commission in
~~~ritin~~. Not~~~ithstanding the t~~regoing. the Commission hereby accepts. in ad~~ance. any
purchase of the Propcrtics pursuant to the Commissions initial purchase ofl~cr provided
consistent ~~~ith the terms of this Resolution and deemed by Ie~al counsel to be
substantially similar to a Uniform Acquisition Offer but to pro~~ide for a negotiated
purchase, ~~,~hich may include the acquisition of an option, the payment of expenses
incidental to the con~~cyance and determination of title, and to the extent applicable.
