AN ORDINANCE ADOPTING THE PROVISIONS OF THE AREA PLANNING
ACT, CHAPTER 138, ACTS OF 1957, INDIANA GENERAL ASSEMBLY,
AS AMENDED
WHEREAS, expanding urbanization within the County of St. Joseph
and the City of South Bend, Indiana, has created many new problems
involving streets and highways) transportation, drainage, water,
land use, schools, and recreation, which are beyyond the ability
of the County) the City) or any other single city or town within
the County to solve; and
WHEREAS, the Area Planning Act, Chapter 138, Acts of 1957, Indiana
General Assembly, as amended, authorizes the County, the City,
and other cities and towns within the County to establish
cooperatively a single and unified planning and zoning agency
to deal with these problems on a county -wide basis so as to
improve the health, safety, convenience, and the welfare of their
citizens and to plan for the future development of the County, the
City, anis�a g ct�e�i�gs�nt County to the
end that/ n w LYo uni ies grow only tai a e'qua d street, utility,
health, educational and recreational facilities; that the needs
of agriculture, industry, and business be recognized in future
growth, that residential.areas provide healthy surroundings for
family life; and that the growth of the County, the City, and
such other cities and towns within the County is commensurate
with and promotive of the efficient and economical use of public
funds;
NOW, THEREFORE, be it ordained by the Common Council of the City
of South Bend, Indiana, that:
Section 1: The provisions of said Area Planning Act creating
an Area Planning Department in the County composed
of an Area Plan Commission, an Area Board of
Zoning Appeals, an Executive Director, and such
staff as the Area Plan Commission considers
necessary, and all other provisions of said Area
Planning Act are hereby adopted.
Section 2: The representatives of the City to the Area Plan
Commission shall be seven (7) in number as provided
by statute, as follows:
A member of the Board of Public Works, the

by the Mayor,

The terms of office of the five (5) citizen
members shall be as follows:
One (1) for a term of one (1) year;
One (1) for a term of two (2) years;
One (1) for a term of three (3) years; and
Two (2) for a term of four (4) years.
The terms shall expire on the first day of January
of the first, second, third, or fourth year,
respectively, following their.appointment. There-
after, as the terms expire, each new appointment
shall be for a term of four (4) years. A member
is eligible for reappointment. If a vacancy
occurs by resignation or otherwise, among the
citizen members, the Mayor shall appoint a member
for the unexpired term.
The term of a member other than a citizen member
shall be co- extensive with his term of office,
unless the Common Council shall at its first
regular meeting in each year, appoint another
member to serve as its representative.
Section 3: Said Area Planning Department shall be established
on January 1, 1965.
Section 4: This ordinance shall be in full force and effect
from and after its passage, signing, and advertise-
ment as provided by law.
