The parking garages o~~med or operated by the South Bend Rcdcrclopmcnt Commission arc all located in South Bcnd. Indiana, and described as follo~i~s: • 131 East Wavne Street. Wavnc Street Garage -Owned by the Rcde~~elopment Commission • X35 Main Street. Main Street Garage -Operated by the Rede~~clopment Commission • 1 I ~-1 ~ 1 South Michigan Street City Garage-Operated by the Rcde~~clopmcnt Commission TERM OF ~9ANAGEMENT SER~~'ICES. The term of the management services shah be for a period of tlu~ec (3) year, commencing on February I. 2009, and terminating on January 31.20 L'. SCOPI? OF GARAGE 11ANAGEn9ENT SERVICES. Each bidder is specitically instructed to become completely familiar ~~'ith the garages prior to submitting a bid. The Bidder agrees to perform the follo~~~ing sen~iccs: • Manage and operate the parking scr~iccs at the Garages; • Furnish the personnel for the operation of the Garages. including c~~ening attendants: • Collect parking receipts and make deposits of all rcrenucs into a bank account designated by O~~~ner on a daiw basis: • The Bidder shall kcq~ a com~~letc account of all re~~enues and expenses arising ti-om the operation of the Gara~~es including parking revenues, receipts. operating expenses topics of daily sales reports, deposit slips and disbursements, and shall furnish to 0~~~~ncr on or before the 1>°i day of each month with a statement of such re~cnues and expenses for the preceding month; • Consult ~~~ith O~rner on parkin<~ matters; and • Prepare and submit to O~~~ner a proposed Budget for the operation and maintenance of ~araaes. PARKING OPERATION. Parking talcs, hours and methods of operation, free parking, ifany discounts and allo~~~~ances shall be determined and directed in ~~~riting by Owner to the Bidder. The Bidder ~~-ill make the City Garage a~~ailable at the direction of O~~~ner for Special cent use. TAXF,S AND ASSESSMENTS. The Bidder shall not be responsible for the payment of any taxes and assessments ]e~~icd upon or assessed ~t~ith respect to the real and personal property contained in or upon the Cara*es. LIABILITY INSLRANCE AND INDEMNIFICATION. The Bidder shall insure, indemnify and hold O~~ner, its agents and employees. harmless a~~ainst any and all liability and loss ~~~hatsoe~~cr arisin~~ fi~<~m any damage. injury. claim ~~r demand caused by the acts, misconduct errors. omissions or negligence of the Bidder and its agents or employees during the scope and course of their contract pertaining to the Garages. The Bidder shall pro~~ide and pay for comprchensi~c general liability insurance, property damage insurance and garage I:eeper~s Ic~~al liabilit} insw<mce [o a combined single limit of (hie Million Dollars ($1.000.000.00) and statuton co~~~ra~~c for ~~orlcer~s compensation insurance. The Bidder shall ha~~c the right to be self insured for such co~~eragc and limits as are permitted or npproced by the State of Indiana for the Bidder from time to time. O~~mer shall be named as an additional insured under the insurance policy or policies pro~~ided above. O~s~ner shall indemnify and hold the Bidder harmless against any and all liability and loss ~~hatsoc~cr arising from any damage. injury. claim or demand caused by the design or structural condition of the Garages. or use or tenanc~~ of the location. SECLRITI'. The Bidder shall exercise reasonable efforts to procidc for the general security of autonu~biles in the Garages and shall exercise reasonable effort to notify Owner of any dangerous situations in the Garages. The Bidder shall not ha~~e any duty to pro~~ide a guard se~~ice or other security scr~-ice in connection with the operation of the Gara~cs. INDEPENDENT CONTRACTOR. O~~~ner and the Bidder are not to be deemed as partners or joint ~~cntures, and that the scr~~ices to be rendered by the Bidder arc as an independent contractor. All personnel for the management of the Gara~~es shall be employees of the Bidder and not of the O~~~ner. NON-DISCR1~111NAT1O1. The Bidder shall not discriminate a~~ainst any e~uploye~ or applicant for employment to be employed in pcrtormance of the management of the Garages ~~~ith respect to his or her hire, tenure. term conditions or ~~ri~~ileges of employment or anv other matter directly or indirectly related to employment because of his or her race. color. rcli~~ion. sex. handicap. national on<~in or ancestry. BID EFALCA"PION. The Raic~elopmcnt Commission shall c~~aluate and consider the follo~zing factors in its re~~ie~~ of C3ids: 1 . The degree to ~~~hich the hid meets the objecti~~es of the Deg elopment Plan fir the South Baul Central Dc~~clopment Area and meets or exceeds the Scope of Gay age Management Sen-ices stated abo~~c. 2. The Bidders tinancial responsibility. qualifications. experience and ability to manage the Parking Garages ~~~ith reasonable expertise. 3. The Bidders proposed mana~~emenl f~c. 4. l~he Bidders compliance ~~~ith all applicable General Requirements stated belo~~. 5. The immediate and loner term potential impact on employment in the area anticipated to result li~om the Biddcr~s proposal. 6. Am other lactors ~~hich will assure the Commission that the Bidders proposal ~G~ill further the execution of the South Bend Central Development Arca De~~clopment Plan and ~~~ill scr~c the interests of the community from the standpoint of both human and economic w~cliare. GENERAL REQUIRED9ENTS. 1 . All of the pro~~isions of LC. 36-7-14-~~ will apply to the bidding process. ?.
