COMMISSION APPROVING AND AUTIIORILING 7`H F, EaECUT10N~
OF AN AGENCY AGREEMENT Bl' AND BET~~'EEN THE SOUTH BEND
REDEVELOPMENT CO~ti1MISS101 AND THE CITI' OF SOUTH BEND,
INDIANA, B0,4RD OF PUBLIC ~~'OKhS RELATING TO THE
MA~~AGEJ9EN'T OF PARKING GARAGES
~~'HEREAS, the South Bend Board of Public Works (the "BPW~~~ is the o~~ner of the
parkingg garages located at:
~~5 Main Strcct. Main Strcct Garage
• 1 18-1 ~ I South Michigan Strcct. City Garage
(the `Cite Garages"): and
WHEREAS, the Department of Rede~~dopment, acting by and through its Rede~clopment
Commission (the "Conunission~~) is the o~~ner of the parking garage located at:
• 1? 1 East Wa~~ne Strcct Wayne Strcct Garage
(the "Commission Gara~~c~~): and
!WHEREAS, the Commission is preparing bid specifications f~~r the management of the
Commission Gara~~c: and
~Vl1EREAS, the BPW desires that the Commission act as the agent ofthe BPW in preparing
bid specifications and entering into a management agrccment fbr the City Gara~~cs (the ~~Project")
and
~VHERF,AS. the BPW and the Commission desire to enter into an agency agrccment ~hercin
the Commission shall act as the agent of the BPW ~~ ith respect to the Project a copy of said Agency
Agreement is attached hereto and incorporated herein as Exhibit "A".
NO~~', THEREFORE, 6E IT KESOLV'ED by the South Bend Redevclopmcnt
Commission as fi~llows:
Section I. The Commission hereby appro~~es the Agenc~~ Agreement and hereby
authorizes its execration in substantially the tbrm attached hereto as Exl-+bit "A" ~a~ith such changes
as the Commission may deem necessary or appropriate upon the ad~~iee oi~ counsel. said execution
thereof to be a>nclusi~~c c~~idencc of the Connnission~s approval of such chan~>es. ~I~hc Clerk is
hereby directed to iilc a copy of the Agency Agreement ~~~ith the [3PW.
Section ?. This Resolution shall be in full ibrce and effect after its adoptio^ by the
Commission.
