'o7/ %a -G 7` AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 Be it ordained by the Common Council of the City of South Bend, Indiana: Section 1 That Zoning Ordinance No. 3702, as heretofore amended be and the same is hereby further amended and supplemented by changing the zoning classifica- tion of the following described property .from "D ", "Light Industrial" Use, and "F" Height and Area District, to "B" Residential Use, and "B" Height and Area District: A part of Bank Out Lot Numbered 91 as shown on the Second Plat of Out Lots of the Town, now City of South Bend, as platted by the State Bank of Indiana, described as follows: viz; Beginning at the intersection of the East line of said Bank Out Lot No. 91, with theSc itherly line of the former right -of -way of the Grand Trunk Western Railway Company; thence South along the East line of Bank Out Lot No. 91, a distance of 254 feet; thence West a distance of 346 1/2 feet tothe West line of said Bank Out Lot No. 91; thence North along the said West line of Bank Out Lot No. 91, a distance of 130 feet to the Southerly line of said former right -of -way of the Grand Trunk Western Railway Company; thence Northeasterly along said former right -of -way of the Grand Trunk Western Railway Company to the place of be- ginning, containing 1.60 acres more or less, excepting therefrom that portion taken off of the East side of said above described Real Estate heretofore conveyed to the City of South Bend for the widening of Laurel Street in said City: That Zoning Ordinance No. 3702, as heretofore amended, be and the same is hereby further amended and supplemented by changing the zoning classification of the following described property from "E ", "Heavy Industrial ", and "F" Height and Area District, to "B" Residential Use District, and "B" Height and Area District: All that part of Bank Out Lot Numbered 92 of the Second Plat let & 2nd READI"!6 °7 /3 �G �of Out Lots of the Town, now City of South Bend, that lies CgF9l6aTTEE Of THE WH91t North of the present right -of -way of the New York Central P48ilQ HEARIR6 a�-, !7aii�337.road Company and South of the former right-of-way of 3rd READR@0 7,A 2-6 NOT APPROVED REFERRED PAMU '% the Grand Trunk Western Railroad Company, that is all of said Lot Numbered 92 that lies between said Railroad com- panies right-of-ways. Also Lots Numbered 1 to 22 inclusive in James Reynolds Subdivision (now vacated) of a part of Bank Out Lot Numbered 91 of the Second Plat of Out Lots of the Town, now City of South Bend, together with the vacated alleys in said subdivision and vacated Reynolds and Perkins Streets, excepting therefrom a strip of land off of the South Side thereof heretofore conveyed to the New York Central Railroad by a deed dated March 28, 1928, recorded March 29, 1928, in Deed Record 216, pages 608 -609, said tract being more fully described as follows:' Beginning on the West line of Laurel Street in the City of South Bend at a point 25.4 feet South and 20 feet West of the intersection of the East line of Bank Out Lot Numbered 91 with the Southerly line of former right-of-way of the Grand Trunk Western Railroad Company; thence West along the North line of said Reynolds Subdivision (now vacated), a distance of 326 1/2 feet to the West line of said Bank Out Lot Numbered 91, thence South along said line to the Northerly line of the right -of -way of the New York Central Railroad as established by a deed to said railroad in Deed Record 216, pages 608 -609, thence Southeasterly along the North line of said right -of -way to a point on the West line of Laurel Street 637.7 feet South of the South line of Western Avenue; thence North along the West line of Laurel Street 357.3 fett, more or less, to the place of beginning. Co., New York Central Railroad Co, and Laurel St.) Respectfully report that they have examined the matter and that in their opinion this ordinance be reported to the Council as favorable. Chairman July 7, 1964 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the City Planning Commission to rezone from "E" Heavy Industrial Use and "D" Light Industrial Use and "F" Height and Area District to "B" Residential Use and "B" Height and Area District a triangular parcel of land bounded on the North by the Southerly right -of -way of the Grand Trunk Western R. R. Co., on the South by the Northerly right -of -way of the New York Central R. R. Co., and on the East by the West right =of -way of Laurel Street was legally advertised under date of June 22, 1964 and given public hearing on July 2, 1964. The following action was taken: After due consideration the Commission found that the proposed rezoning would be in the best interest of the City and the subject area. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended favorably to the Council.
