Be it ordained by the Common Council of the City of South
Bend, Indiana;
Section I. Ordinance No, 3702, being the zoning ordinance
of the City of South Bend, be, and the same hereby is amended so
that the zoning classification of the following described real
estate in the City of South Bend, St. Joseph County, Indiana, towit:
" A tract of land taken out of the vast one -half (1/2) of
the :Southeast One- quarter (1/4) of Section Five (5),
Township 37 North, a'.ange 3 past, described as follows:
Beginning at a point one hundred and sixty (100) feet
North of the intersection of the center line of McKinley
Avenue or U.S. Highway No. 20 and the cast line of said
Section Five (5); thence West one hundred and eighty -
seven and fifty -seven one hundredths (187.57) feet; thence
North one hundred and thirty -five (135) feet; thence east
one hundred and eighty -seven and fifty -seven one - hundredths
(187.57) feet to the Nast line of said Section Five (5); thence
6outh one hundred and thirty -five (135) feet to the place
of beginning,"
be, add the same is hereby changed from 11C -1" Commercial District
to "C" Commercial :District.
Section II. This ordinance shall be in full force and tale
effect from and after its passage by the Common Council, approved by
the Mayor, and Legal Publication.

Gentlemen:
The attached petition of Clarence & Martha Dockery, et al,
to rezone from "C -1" Commercial Use and "A" Height and
Area District to'C" Commercial Use and "B" Height and Area
District the property generally described as a rectangular
parcel of land 120 feet North of the North right -of -way
line of McKinley Avenue and having 135 feet frontage on
the west right -of -way line of Hickory Road was legally
advertised under date of December 28, 1964 and given public
hearing on January 7, 1965. The following action was
taken:
After due consideration the Commission found
that the proposed zoning would be in the best
interest of the subject area, the neighborhood,
and the community. It was therefore duly moved,
seconded, and unanimously carried that the petition
be recommended favorably to the Council.
