Attached to this staff report is Resolutions 2507 which relates to property at 911 Marietta Street within the
Airport Economic Development Area. The property contains amulti-story house and an adjacent vacant lot.
The property is located in an area in which the Redevelopment Commission has purchased properties over
the last seven years. The property was added to the Sample-Ewing Development Area acquisition list by
Resolution 1839 on July 7. 2001.

Resolution 2507
The purpose of Resolution 2507 is to set the acquisition value for the property at 911 Marietta. The property
consists of a two story house and an adjacent vacant lot with total property dimensions of 50 x 130' (6,459
SF). The average appraised value as determined by two qualified appraisers in 2001 was $47.840.00.
However, at this time, the house is being sold as part of a settlement for Medicaid and is presently listed for
sale at $11,900.00. The house has been damaged by vandals and was planned to be a tear-down so the
reduced value is very acceptable.
This property, along with 24 others, was added to the SEDA Acquisition List in 2001 as part of a strategy to
acquire substandard housing and commercial parcels that were located in an area adjacent to then recently
constructed Southeast Neighborhood Park. The acquisition purpose was twofold: removing the non-
consistent land uses and create an area for a future expansion of the park. The "Sample Triangle" is bounded
by the railroad, Sample Street and High Street. The Commission has assembled 32 of the total 41 parcels to
create this development site. The acquisition of these two parcels would leave one commercial structure (3
lots with one building and all are on tax sale) and one single family house (2 lots) to be acquired. One of the
lots is owned by Sprint and contains a telecom building and the last lot is owned by the railroad.
Summary
Staff requests approval of Resolutions 2507 to acquire the property at 911 Marietta. The Commission owns
the adjacent parcels and this acquisition is in keeping with past Commission acquisitions. The house; in its
present condition, is a nuisance property that needs to be demolished. The reasonable price for the
acquisition is key to this transaction and staff requests your favorable approval.

A RESOLUTION OF THE SOUTH BEND REDEVGLOPI9ENT COMJIISSION
RELATED TO ACQUISITION OF PROPERTY IN THG
AIRPOR"T ECONOMIC DG~'ELOPMENT AREA
WHEREAS. under the authority granted by Indiana Code ~ 36-7-14, c'1 sc~y.
and in furtherance of the Airport Economic De~~elopmcnt Area Plan ("Plane), the South
Rend Rederelopmcnt Commission ("Conunission~~) has determined that it is necessary to
acquire unencwnbered fee simple interest in certain properties located ~~ithin the area
heretofore deli<~nated as the Airport Economic Development Area (the "Arca~~) within
the City of South Bend, Indiana (the "Citv~~), which properties arc more particularly
dcscribcd at Exhibit A attached hereto and incorporated herein (thc-~Propertics~~): and
WHEREAS, on July 7. 2001. the Commission adopted Resolution No. 1839
amending the Plan and adding the Properties to the former Sample-Ewing Dc~-elopment
Arrz~s acquisition list; and

2001 in accordance with Indiana Code ~ 36-7-14-19(b). ~~hich provide the otia-ing

WHEREAS. the Commission now desires to authorize the staff of the
Commission to provide and negotiate an oftcr for the Purchase of the Properties in
accordance .with Indiana Codc ~ 36-7-14-19. which may include the acquisition of an
option and the Commission's pa~mcnt of expenses incidental to the conve~~ance and
determination of the title of the Properties and
WHEREAS, the Commission finds that all procedures necessary for authorizing
and acquiring the Properties have been completed in accordance with Indiana law;
'~~O\y%, THEREFORE. BE IT RESOLVED by the South Bend Redevclopmcut
Commission that:
1 . The staff of the Commission arc hereby authorized and directed to cause a
purchase oft~cr to be made in ~~riting to the owner(s) of the Properties as described at
Exhibit A at the Sale Price. ~~~hich is less than the Average Acquisition Price in
accordance ~~~ith Indiana Codc ~ 36-7-14 19, ~i~hich offer or process may include the
acquisition of an option for the pm chase price and the payment of expenses incida~tal to
the conveyance and determination of the title of the Properties.
?. ~I he Commissions attorney is hereby authorized and directed to ne~~otiatc
and prepare documentation necessary to accomplish the acquisition of the Properties in
accordance avith this Resolution and in a form acceptable to Icgal counsel.
~. No representations, contract or understanding relative to the purchase of
the Properties, w-hethcr made by a Commissioner. employee or other agent or official, is
binding against the Commission until approved and accepted by the Commission in
avriting. Nona-ithstanding the foregoing, the Commission hereby accepts, in advance, any
purchase of the Properties pwsuant to the Commissions initial purchase offer provided
consistent avith the terms of this Resolution and deemed by lc~aa] counsel to be
substantially similar to a Uniform Acquisition Oficr but to provide for a negotiated
purchase, aa~hich may include the acquisition of an option, the payment of expenses
incidental to the conveyance and determination of title. and to the extent applicable.

Commission any documents necessary to carry out the intent of this resolution.
