BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. SECTION 1. Maintenance, etc., prohibited. That Chapter 16, Article 4, Section 35 of the Municipal Code of the City of South Bend, Indiana be and hereby is amended so as to read as follows: It shall be unlawful for the occupant, tenant, or owner, or the agent of any such owner, of any lot, place or area within the City of South Bend, Indiana to permit or allow to remain on such lot, place or area, or upon the sidewalks or alley- ways abutting the same, any weeds, grass, or deleterious unhealthful growths over 12 inches high or other noxious matter that may be growing, lying, or located thereon. SECTION 2. Notice to occupant, tenant or owner, or agent of owner. Chapter 16, Article 4, Section 36 of the Municipal Code of the City of South Bend is hereby amended so as to read as follows: the Health Department is hereby authorized and empowered to give five (5) days' notice in writing to the occupant, tenant, owner, op, the agent of any owner of aray lot, place or area within the City of South Bend, Indiana to cut, destroy, or remove any weeds, grass or deleterious unhealthful growths over 12 inches high or other noxious matter found lying or located on any such property or upon the sidewalks or alleyways abutting the same. Such notice shall be addressed to any such person at his last known address. SECTION 3. Offense -- declaration of nuisance. Chapter 16, Article 4, Section 37 is hereby repealed and the following substituted therefore: the failure, neglect or refusal of any occupant, or tenant or owner, or agent of any owner to comply with any notice served upon such person pursuant to Section 16 -36 of this Ordinance shall constitute a violation of this Ordinance and each day's failure, neglect or refusal shall constitute a separate offense. It is hereby declared that the permitting or allowing to remain on any lot, place or area or upon the sidewalks or alley- ways abutting the same any weeds, grass, or deleterious unhealthful growths over 12 inches high or other noxious matter shall constitute a public nuisance. SECTION 4. Penalty. Chapter 16, Article 4, Section 38 of the Municipal Code of the City of South Bend, Indiana is amended so as to read as follows: any occupant, tenant, owner, or agent of such owner of any lot, place or area within the City of South Bend, Indiana who violates any provision of this Article, after due notice is given pursuant to Section 16 -36 of this Ordinance and fails to remove weeds, grass or deleterious unhealthful growths over 12 inches high or other noxious matter that may be growing, lying or located within any such lot, place or area, or upon the sidewalks or alley- ways abutting the same on conviction thereof shall be fined for each offense not less than $20.00 nor more than $300.00. Each violation shall constitute a separate and distinct offense.
