J(02, AS AMENDED, COM- MONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA BE IT ORDAINED BY THE COMMON COUNCIL " OF THE CITY OF SOUTH BEND, INDIANA: Section 1. Ordinance No. 3702, as amended, which ordi- nance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real es- tate in the City of South Bend, St. Joseph County, State of Indiana: A portion of the South half of the Southwest quarter and a portion of the South half of the Southeast quarter of Section 353 Township 38 North, Range 2 East and a part of the City of South Bend, Portage Township, St. Joseph County, Indiana, more particularly described as follows: Beginning at a point which is the point of intersection of the centerline extended of the alley North of Kinyon Street with the center line of Riverside Drive, said point of beginning being One Thousand Three Hundred Thirty and Sixty -Seven Hundredths (1330.67) feet East of the center- line of Sherman Street; thence Westerly along and with the North line of the South half of the Southeast quarter of Section 35, a distance of One Thousand Three Hundred and Sixty -seven Hundredths (1300.67) feet to the point of intersection with the Easterly right -of -way line of Sherman Street; thence Southerly along and with the East right -of- way line of Sherman Street a distance of Five Hundred Twenty -three and Five Tenths (523.5) feet to the South right -of -way line of Queen Street; thence Westerly along and with the South right -of -way line of Queen Street a distance of Two Hundred Six (206) feet; thence Southerly along a line parallel to the East right -of -way line of Sherman Street a distance of Three Hundred Sixty -Four and Ninety -two Hundredths (364.92) feet; thence Easterly along a line parallel to the South right -of -way line of Queen Street a distance of Five Hundred Eighteen and Sixty -four Hundredths (518.64) feet to the centerline of Riverside Drive; thence Northeasterly along and with the centerline of Riverside Drive to the point of beginning; excepting from the above described tract of land the following: A parcel of land beginning at a point which is the point of intersection of the centerline extended of the alley North of Kinyon Street with the centerline of Riverside Drive, said point of beginning being One Thousand Three Hundred Thirty and Sixty -seven Hundredths (1330.67) feet East of the centerline of Sherman Street; thence Westerly along and with the North line of the South half of the Southeast quarter of Section 35, a distance of One Thous- and Twenty (1020) feet; thence Southeasterly along a line with a deflection angle of One Hundred Twenty -four Degrees, Forty Minutes Left (124040'L) a distance of Six Hundred Twenty (620) feet, more or less, to the point of intersec- tion with the centerline of Riverside Drive; thence North - easterly along and with the centerline of Riverside Drive to the point of beginning, also A parcel of land beginning at a point which is the point of intersection of the South right -of -way line of Queen Street with the centerline of Sherman Street, said center- line of Sherman Street being the East line of the South half of the Southwest quarter of said Section 35; thence Westerly along and with said South right -of -way line of Queen Street, a distance of One Hundred Seventy -six (176) feet; thence Southerly along and with a line parallel to the East right -of -way line of Sherman Street, a distance of Three Hundred Sixty -Four and Ninety -two Hundredths (364.92) feet; thence Easterly along and with a line parallel to the South right -of -way line of Queen Street, a distance of One Hundred Seventy -Six (176) feet to the East line of the South half of the Southwest quarter of Section 35; thence Northerly along and with said East line of the South half of the Southwest quarter of Section 35, a distance of Three Hundred Sixty -four and Ninety -Two Hundredths (364.92) feet to the point of beginning. Said tract of land containing Nine and Two- Tenths (9.2) acres, more or less. be and the same hereby is changed from a "D" Light Industrial Use District and a "D" and "E" Height and Area District to a "B" Residence Use District and a "B" Height and Area District. Section 2. MURPHY. — . -ARI.1 —TOP The attached petition of Riverside North 1600, Inc., et al, to rezone from "D" Light Industrial Use and "D" and "E" Height and Area District to "B" Residential Use and "B" Height and Area District 9.2 acres, more or less, fronting on Riverside Drive and bounded on the west by Sherman Avenue and on the north by the rear lot line of those lots fronting on the south side of Rose Street was legally advertised under date of July 26, 1965 and given public hearing on August 5, 1965. The following action was taken: After due consideration the Commission found that the proposed zoning would be in the best interest of the subject area and of the City.
