HomeMy WebLinkAboutApproving, Ratifying and Confirming a Certain Contract Between City of South Bend & Northern Indiana Transit IncORDINANCE NO. 4724__65 Passed by the Common Council of the City of South Bend, Indiana I Presented by me to the Mayor of the City of South Bend, Approved and signed by Clerk Of Common Council Clerk IDEAL aQW PRIZES AN T CITY OF SOUTH BEND ORDINANCE NO. zZ2,2_ AND ENTERED INTO BY AND BETWEEN THE CITY OF SOUTH BEND, INDIANA, ACTING BY AND THROUGH ITS BOARD OF PUBLIC WORKS AND THE RATES CHARGED FOR BUS TRANSPORTATION SERVICE UPON CERTAIN STREETS AND HIGHWAYS IN SAID CITY. WHEREAS, heretofore, to -wit: on the 14th day of December, 1964, the City of South Bend, Indiana, acting by and through its Board of Public Works and Safety, entered into the following contract with Northern Indiana Transit, Inc.: CONTRACT THIS CONTRACT, made and entered into this 14th day of December, 1964, by and between the CITY OF SOUTH BEND, INDIANA, acting by and through its Board of Public Works and Safety, hereinafter called the First Party, and NORTHERN INDIANA TRANSIT, INC., a corporation organized under the laws of the State of Indiana, its successors and assigns, hereinafter called the Second Party, WITNESSETH: The parties hereto agree that the certain contract made be» tween the parties on or about May 13, 1940 and thereafter confirmed by Ordinance of the Common Council of the City of South Bend, and as sub- sequently further amended and confirmed by Ordinances of the Common Council of the City of South Bend, and last amendment by contract dated February 23, 1962, and confirmed by Ordinanee of the said Council shall be and is hereby amended in each of the following respects: All provisions in said Contract, as amended, regarding cash and token fares shall be eliminated, and the following provisions shall be substituted in lieu thereof, to wit: kL°D KATHRYN L. SLOUGH C'TY CLERK, SOUTH BEND, IND. 1. Adult - Cash Fare. . . . . • 30� . Token Fare . . . . . . . , . . 8 for $2.00 2. Special Childrents Fares: a. All children under five years of age, accompanied by a fare paying passenger. . . No Charge b. All children age 5 years to 12 years, both inclusive, at all times . . . . . a . 15¢ Token Fare . . . . . . . . . . . 2 for 25� c. School fares for high school and grade school students over 12 years, attending school between the hours of 6 :30 A. M. and 4:30 P. M. e . . . . . . . . . . . . . 20�. All provisions in said contract, as amended, regarding transfers, shall remain the same. The Second Party shall furnish service to the public over the routes now presently established. Said contract made between the parties on the 13th day of May, 1940, amended as hereinabove set forth, and as now amended, shall be and is hereby continued in full force and effect. Anderson Superintendent AND WHEREAS, said contract has been submitted by said Board of Public Works and Safety of the City of South Bend, Indiana, to the Common Council of said City for its consideration and action thereon: THEREFORE, Section 1' BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, that the foregoing contract and agreement, made and entered into the 14th day of December, 1964, by the City of South Bend, Indiana acting by and through its Board of Public Works and Safety, and Northern Indiana Transit, Inc., be and the same is hereby in all things approved, ratified and confirmed, and said Northern Indiana Transit, Inc., its successors and assigns, is hereby granted the right, privilege and authority as in said contract and agreement set forth, and in accordance with the terms, provisions and contents thereof. Section 2. This ordinance shall take effect and be in force from and after its passage by the Common Council and approval by the Mayor of the City of South Bend, Indiana.
