CITY OF SOUTH BEND ORDINANCE NO. AN ORDINANCE AMENDING ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND, AS AMENDED, FOR THE PURPOSE OF CHANGING THE ZONING OF CERTAIN LAND SITUATED WITHIN THE CITY OF SOUTH BEND, INDIANA, FROM "A" RESIDENCE DISTRICT TO "C" COMMERCIAL DISTRICT. BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, that Zoning Ordinance No. 3702, as amended, be and hereby is further amended as follows: SECTION 1. The use classification of the following described lands within the City of South Bend, Indiana, is hereby changed from "A" Residential to "C" Commercial: Lots Numbered Eight (8), Nine (9) and Ten (10) as shown on the Recorded Plat of wooded. Estates, a subdivision of part of the Northeast Quarter (g) of Section Six (6), Township Thirty -seven (37) North, Range Three (3) East, now a part of the City of South Bend, together with the North Half (z) of that part of the vacated alley lying South of and adjoining said lots. SECTION 2. This Ordinance shall be in full force and effect from and after its enactment by the Common Council, its approval by the Mayor and legal publication thereof. A-1.1 -1 owm.on The attached petition of Joseph and Tina Zappia was legally advertised on March 22, 1965 and given public hearing on April 1, 1965. The following action was taken: After due consideration the Commission found the commercial use of subject property would be an unwarranted extension into a residential neighborhood; that ample commercial property exists; that the property is not necessarily commercial in nature; that residential uses exist to the north and to the west; that there is no demonstrated need for additional commercial land in the vicinity; that, in fact, there exists approximately 1800 feet of unused commercial zoning between Edison and South Bend Avenue on Ironwood and that therefore sufficient commercial, sufficient vacant commercial as well as commercially zoned land not used for commercial purposes exists in the area.
