AN ORDINANCE AUTHORIZING THE PURCHASE OF
LAND BY THE CITY OF SOUTH BEND, INDIANA,
WHEREIN THE PURCHASE PRICE EXCEEDS THE
SUM OF $2,000.00.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
WHEREAS, the State Highway Commission of the State of Indiana
has let a public contract for the improvement of Western Avenue
as it extends through the City of South Bend, Indiana, said
Western Avenue being otherwise known as State Road No. 2 and,
WHEREAS, it is the best interest of the City of South Bend,
Indiana that when said improvement is accomplished that said State
Highway should be widened in the vicinity of the intersection of
Laurel Street and said Western Avenue and,
WHEREAS, it is the responsibility of the City of South Bend,
Indiana by agreement with the State Highway Commission of the
State of Indiana to acquire the necessary right of way for such
widening and,
WHEREAS, the parcel of real estate necessary for the widening of
the approach to said intersection is now privately owned and,
WHEREAS, the purchase of said real estate will exceed the sum of
$2,000.00,
NOW THEREFORE, BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA:
SECTION I. Tha the purchase b the City of South Bend, Indiana
for the sum of P24 Dollars of the following
described real est -aafe in the County of St. Joseph, City of
South Bend, State of Indiana, to -wit:
A parcel of land located in a part of bank out lot
No. 91 second plat of out lots City of South Bend
described as follows viz:
Beginning at the intersection of the south
line of Western Avenue (formerly Division Street)
and the west line of Laurel Street as presently
located; thence south along the west line of the
above mentioned Laurel Street a distance of 15
feet, thence west parallel with the south line of
the above mentioned Western Avenue (formerly
Division Street) a distance of 85 feet; thence
northwesterly along a straight line 75 feet to a
point on the south line of Western Avenue (formerly

Division Street), said point being 166.5 feet west
of the point of beginning; thence east along the
south line of Western Avenue (formerly Division
Street) 166.5 feet to place of beginning, except-
ing therefrom that portion taken off of the east
side of said above described real estate hereto-
fore conveyed to the City of South Bend for the
widening of Laurel Street in said City,
is authorized by the Common Council of the City of South Bend,
Indiana, pursuant to the authority contained in the Acts of the
Indiana General Assembly for 1905, Chapter 129, Section 93.,
Page 219, as amended by the Acts of the Indiana General Assembly
of 1909 and 1913.
SECTION II. This Ordinance shall be in full force and effect
after its adoption by the Common Council of the Civil City of
South Bend, Indiana, and approval by the Mayor.
