AN ORDINANCE REPEALING SECTION II OF CHAPTER 26 OF ORDINANCE NO. 4608 -63, BEING THE MU- NICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATING TO ALCOHOLIC BEV- ERAGES BEING PROHIBITED IN CERTAIN PLACES, AND SUBSTITUTING NEW SECTIONS IN LIEU OF THOSE REPEALED. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I That Section II of Chapter 26 of the Municipal Code of the City of South Bend, Indiana, 1962, be and it is hereby repealed. SECTION II. In Lieu of the Section repealed by Section I of this Ordinance, the following is hereby substituted and enacted: Section 26 -2 - Alcoholic Beverages - Possession, display, etc., prohibited in certain places. It shall be unlawful for any person to carry any alcoholic spirituous beverage or beverage containing alcohol into any public building, park, school, playground, recreation or ath- letic field, stadium or place wherein any public entertainment or public meeting is held, drive -in restaurant, or parking lot, for the purpose of consuming the same or for displaying the same or for the purpose of selling, furnishing, or giving away the same to another on such premises or for the purpose of having the same then or there served to him or another. It shall be unlawful for any person to consume the same in any such place or to consume the same upon the streets, alleys or sidewalks of the City. The provisions of this Section -shall not apply to any place properly licensed by the Alcoholic Beverage Commission of the State. SECTION III. This Ordinance shall be in full force and effect from and after its adoption by the Common Council of the Civil City of South Bend, Indiana, and its approval by the Mayor.
