HomeMy WebLinkAboutNotice of Executive Order 1-2014 5pD T$BE O V\Iii�ClJii O v x X865 CITY OF SOUTH BEND PETE BUTTIGIEG, MAYOR OFFICE OF THE MAYOR NOTICE OF EXECUTIVE ORDER 1-2014 Amending the City of South Bend Ethics Code as originally set out in Executive Order 1-2012 and Amended April 19, 2013. Notice is hereby given that on the atlhday of February,2014,the Mayor of the City of South Bend, Indiana, executed Executive Order No. 1-2014 which amends Executive Order 1-2012. The significant amendments are summarized below. 1. Headings have been added to enhance readability: Definitions, The Gift Rule,Exceptions to the Gift Rule, Waiver, Political Activity, Conflicts of Interest. 2. The word original in the first introductory paragraph has been deleted, and the second introductory paragraph has been modified to clearly define the applicability of the Ethics Code. 3. Throughout the Order,the words City of South Bend have been modified to City, after the first reference. 4. Throughout the Order,references to any combination of the words officers, officials, appointees, and employees have been modified to the words appointees, employees, or officials. 5. Throughout the Order,the word agency and any combination of the words, board, commission, and department have been replaced with the words board, commission, department, or office(except in quoted material). 6. A Definitions section has been created after the introductory paragraph of the document, preceding the numbered sections. The definition of`confidential information"has been relocated from Section 7. The definition of relatire has been relocated from Section 8. The definition of"honoraria"has been added. 7. From the definition of confidential information, the following words have been deleted: (including, but not limited to e-snails and electronic records). 8. The following words were added to clarify the definition of the enumerated gifts: (collectively, "gifts')for personal benefit.... b. The words has a business relationship or seeks a business relationship with the appointee's or employee's agency or department, or is seeking to influence an action by the appointee or employee in his or her official capacity, or is regulated by the appointee or the employee's agency. have been placed in subsections and modified to read as follows: a. has or seeks a business relationship with the appointee's, employee's, or official's board, commission, department, or office; b. is seeking to influence an action by the appointee, employee, or official in his/her official capacity; or c. is regulated by the appointee's, employee's, or official's board, commission, department, or office. 9. Under the heading Exceptions to the Gift Rule,the following paragraph has been added as Section 2. Former Section 2 is now Section 3: Employees may solicit donations to the City on behalf of the City for specified purposes authorized by the Mayor, determined to be consistent with public interest by the Corporation Counsel. 10. Former Section 2(c)has been deleted; its contents are encompassed by Section 3(a). 11. The former Section 20)(i)has been relocated to Section(3)(c)and restated as follows: Modest ref•eshinents (such as coffee and donuts), greeting cards,plaques, and other similar items of little intrinsic value and items of nominal value received at public ceremonies or commemorating City business. 12. Former Section 2(d),now section 3(d)has been modified.The words Food or chink consumed at a public meeting to which at least ten (10) individuals are invited; a meeting will be considered public if.- ... have been replaced with Food or chink consumed at an event or gathering if.• ... 13. Former Section 2(d)(i),now Section 3(d)(i)has been modified.The words The event is a reception to which at least ten (10) individuals are invited that is not arranged ... have been replaced with The event or gathering it not arranged ... 2 I I I Notice of Executive Order 1-2014 14. Former Section 2(d)(iii), now Section 3(d)(iii)has been modified. The words The meeting ... have been replaced with The event or gathering ... 15. In the former section 2(e), now Section 3(e), the words director of economic development have been modified to Director of Community Investment. 16. In former section 2(f),now Section 3(f),the word agency was changed to City. 17. Former Section 2(g),now Section 3(g),has been changed from: Gifts off-ee attendance at widely attended gatherings, and food or refreshments served at such gatherings,provided that the corporation counsel has determined that the attendance is in the best interest of the agency. to Gifts off ee attendance at certain events or gatherings and food or ref eshrnents served at such events or gatherings,provided that the Corporation Counsel has determined that the attendance is consistent with the public interest. 18. Fortner Section 20)(ii)has been separated into two sections, Section 3(h) and Section 3(i). Section 3(h)now states: Discounts available to the public or to all City employees; Section 3(i)now states: Rewards or prizes connected with competitions open to the general public or open to all persons at events or gatherings under subparts (e) or (g) above. In addition, in Section 3(i),the words ividely attended gatherings under subpart (g) above have been replaced with events or gatherings under subparts (d) or (g) above. 19. In fonner Section 2(h),now Section 30),the words or honorarium have been added. 20. Former Section 2(k), now Section 4 under the new heading Waiver,was consolidated and simplified by adding the words and by whom to subpart(ii)and deleting subpart(iii). Subpart(ii)now states: 3 Notice of Executive Order 1-2014 The nature and estimated value of that which is being provided and by whom; ... 21. Former Section 3,which addressed political activity,was deleted and replaced with a new Section 5, under the new heading Political Activity. 22. The following sentence was added to the former Section 4,now Section 6 under the new heading Conflicts of Interest: If Corporation Counsel determines that the additional work is or might be a conflict of interest, he or she will issue a letter that describes the conflict or potential conflict and directs the appointee, employee, or official regarding actions that should and/or should not be taken to avoid actual conflict. 23. Former Section 6, now Section 8,was modified from: An appointee, employee,former appointee, or former employee shall not disclose or materially benefit fi•orn confidential inforination, as defined in Section 7 below, and shall use confidential information only in the course of his or her performance of official responsibilities. to A current or former appointee, employee, or official shall not disclose or materially benefit fi•o i confidential information, as defined in the City's Ethics Code, and shall use such confidential information only in the course of his or her performance of official responsibilities. 24. Former Section 7,which contains the definition of"confidential information,"was moved to the new heading Definitions. 25. Former Section 8,which defines"relative,"was moved to the new heading Definitions. 26. In the introductory paragraph of former Section 9,the word agency was changed to board, commnission, department, or office. 27.
