AN M INANCE AUTHORIZING THE SALE AND
CO- TRANCE 0^ REAL ESTATE NOW OWNED
BY THE CITY OF SOUTH BEND, INDIANA.
BE IT ORDAINED BY THE COLON COUTNCIL OF THE CITY Or SOUTH BEND,
INDIANA:
SECTION Id That the following described real estate situate in
the County of St. Joseph, City of South Bend, Indiana and owned
by said City, to -wit:
PARCEL
Lot lettered "A" as shown on the recorded Plat of Wenger
and Krieghbaum °s Vistula Avenue Addition to the City of
South Bend also known as Beginning at the property line
at the Southwest corner of the intersection of Sample
Street and Vistula Avenue, now known as Lincoln Way,
East; thence West along the South line of Sample Street,
a distance of 77.4 feet; thence in a Southerly direction
127 feet; thence in a Northeasterly direction, a distance
of 13£3 feet, to the West line of Lincoln Way, East, thence
Northerly 66 feet along the West line of Lincoln Way, East,
to the point of beginning, excepting therefrom the
northerly part described as follows: beginning at the
northwest corner_ of said Lot "A0° thence East along the
north property li:ae of Lot "AQ1 a distance of 77.4 feet to
the northeast corner of Lot "A "; thence Southeasterly
along the easterly property line of Lot "A" a distance of
66 feet to a po_rst -7here the easterly line of Lot "A °1
intersects the northerly line of a 14 foot alley; thence
in a northwesterly direction a distance of 117.2+ feet to
a point 43.3 feet south of the northwest corner of Lot
"A" and in the west property line of Lot "A "; thence North
along the west property line of Lot "A" a distance of 43.3
feet to the northwest corner of Lot "A ", the place of
beginning, containing 4,5£30 square feet or .10 acres,
situated in the City of South Bend, St. Joseph County,
Indiana.
PARCEL 2
A Lot or parcel of land on Sample Street in the City of
South Bend, in the North East Quarter of Section No. 13,
Township No. 37 Borth, Range No. 2 East, bounded by a line
running as follows, viz: Beginning on the South line of
sample Street as now located in said City, which line is
now 25 feet South of and parallel with the North line of
said Section No. 13, at a point 425 feet East of the East
line of High Street in Martin L. Wenger's Second Addition
to said City; thence Sbiith 127 feet to the North line of
an alley 14 feet wide, running East and West parallel with
Sample Street thence East 40 feet; thence North 127 feet;
thence West 40 feet to the place of beginning, excepting
therefrom the northerly part of this tract described as
follows: beginning at the northwest corner of the above
described tract of land; thence east along the north
property line a distance of 40 feet to the northeast corner
of said tract; thence South along the east property line of
said tract a distance of 43.3 feet; thence in a northwesterly
direction a distance of 40.14+ feet to a point in the west
property line, which point is 40 feet south of the north-
west corner of said tract; thence North along the west
property line a distance of 40 feet to the place of beginning,
containing 1666 square feet or .03€32 acres, situated in the
City of South Bend, St. Joseph County, Indiana.
PARCEL 3
A Lot or parcel of land situated in the North part of the
East half ('k) of the Northeast Quarter ('k) of Section
Numbered Thirteen (13), Township Thirty -seven (37) North,
Range Two (2) East bounded by a line running as follows,
vi.z: Beginning or. the South line of Sample Street at a
point Three Hundred Five (305) feet East of the point of
intersection of said South line of Sample Street with the
East line of High Street in the City of South Bend; thence
South on the East line of a street Thirty (30) feet in width,
a distance of One Hundred Twenty -seven (127) feet to the
North line of an alley Fourteen (14) feet in width that runs
East and West on a line parallel with Sample Street; thence
East on the North line of said alley One Hundred Twenty
(120) feet; thence North One Hundred Twenty -seven (127)
feet to Sample Street, thence West One Hundred Twenty (120)
feet to the place of beginning, excepting therefrom the
northerly part of this parcel, described as follows:
beginning at a point on the west line of said tract which
point is 97 feet North of the southwest corner of the
above described tract of land; thence north 30 feet to the
northwest corner of said tract; thence gWalong the north
property line of said tract a distance of 120 feet to the
northeast corner of said tract; thence south along the
east property line a distance of 40 feet; thence in a
northwesterly direction a distance of 120.4+ feet to the
point of beginning, containing 4,200 square feet or .09642
acres, situated in the City of South Bend, St. Joseph
County, Indiana,
shall be sold pursuant to the authority of the Acts of the Indiana
General Assembly for 1905, Chapter 129, Section 53, Page 219, the
50th Clause and pursuant to such authority the 'City is authorized
to petition the Judge of the Circuit Court of St. Joseph County to
appoint three disinterested free holders of the City of South Bend,
Indiana to appraise said real estate and said real estate shall not
be sold for less than such appraised value.
SECTION II. The Mayor of the City of South Bend is hereby authorized
in the name of the City of South Bend to execute any and all
necessary instruments to accomplish the conveyance of said real
estate and the City Clerk is authorized to attest any such
instruments and affix the seal of the City thereto.
SECTION III, This Ordinance shall be in full force and effect
upon its passage by the Common Council by a vote of not less than
two- thirds by the members of said Council and its signature by
the Mayor.
