AN ORDINANCE AMENDING SECTION 40 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA, 1962, AS AMENDED, ALSO KNOWN AS
ORDINANCE NO. 3702, THE ZONING ORDINANCE
OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
That Section 40 of the Municipal Code of the City of South
Bend, Indiana, 1962, as amended, also known as ordinance No.
3702, the zoning ordinance of the City of South Bend, Indiana, be
and the same is hereby amended as follows, to wit:
That the zoning of the following real estate situate in the
City of South Bend, Indiana, and described as follows, to wit:
Three Hundred (300) feet in width, North and South, off
of the entire South side of the Chippewa Knoll realty
which Chippewa Knoll realty is the real estate described
(as follows::
Beginning at the intersection of the South line of Chippewa
Avenue and the Westerly line of South Michigan Street;
thence Southerly on the Westerly line of said South
Michigan Street a distance of 735 feet, more or less, to
the North line of Lot No. 69 in Chippewa Heights Third
Addition in South Bend, Indiana; thence West along the
North line of Lot No. 69 and Lot No. 108 in said Chippewa
Heights Third Addition to the Easterly line of South Main
Street; thence North along the Easterly line of South
Main Street to the South line of Chippewa Avenue; thence
East along the South line of Chippewa Avenue to the point
of beginning.

thereof, South Bend, Indiana, be changed from "B" Residential
Use and "A" Height and Area District to "C" Commercial Use and "A"
Height and Area District.
Section II:
This ordinance shall be in full force and effect from and after
its passage and legal publication.

in support of this application, the following facts are shown:
1. The property sought to be rezoned is located at approximately
