The August 2~, 00~ meeting of the Public UIlark and Property Vacation Committee of
the South Bend ar~n~on Council eras called to order by its Chairperson, Council
Member David Varner at ~~~~ p.rn, in the Council's Informal Meeting Roam.
Persons in attendance included Council Members Kelly, Varner, Pfeifer, I~irsits, ~7ieter,
Kuspa, Rouse, and Pu~~ello;, Mayor Stephen l~uecke, Public 1l11arks ~irectar Cary pilot,
Bernie Feeney, Mrs. l~apola, City Clerk John Vaarde, Barge Herendeer~, Mark
~obsan, Robert Mathis, Jamie ~aa of the Sou~~ ~en~ ~"ri~r~e and Kathleen Cekanki~
Farrand, Council Attorney.
~r~ Varner Hated that the Committee members include Council Members Pfeifer, dieter,
Kelly and himself; along ~vith J. Edv~ard Talley a the Citizen Member,

vacation of the first eastl~rest alley north of Northside Boulevard.

J. Bernard Feeney of Lang, Feeney Associates, lnc~, pith offices located at l~ South
Michigan Street in dov~ntov~n South Bend rude the formal presentation. !fie noted that
the purpose of the vacation is to eliminate the alley vuhic~h access ar~d divides an
exciting parking lot. The parking Iot has access from ~1~t Street. MrF Feeney provided a
~~page handout depicting naps of the area in question copy attached}~ a indicated
that his client vuould provide an access agreement Frith the Fire Departr~ent.

an the information provided by Mr. Feeney all three ~~} items have been addressed.
No one fror~ the public spoke in favor or in apposition to the Bill,
Counci! Member Pfeifer made a motion, seconded by Council Member dieter that
Substitute Bill No. ~-~~ be reon~n~ended fvorablyto Council, The motion passed.
fir. Varner then called far a presentation on Bill No. 49-D7 requesting a vacation of a
porkion of Brick Road right-of-gray in Berman Tor~nship.

l~llr. I~erendeen stated that the land in question is ~ "silver of right-of-gray" ~rhich abuts
the petitioner's property and Brick load. The land in question gas formerly owned by
the state of indiana and vas given to the City of South Bend. The City his na other
use Earths property and has no objection to it becoming part of the petitioner's lat~

Council Ien~ber dieter made ~ motion, seconded by Council I~en~ber Pfeifer that Bill
No. 49-d7 be recommended favorably to Council. The motion passed.
