This garage has a history of its brick veneer delaminating and falling to the ground. Over the years the loose brick has been removed, but each year what was once securely attached becomes loose. This proposal will resolve this issue. It is currently believed the project will be in two phases. Phase 1 will be to this year remove the pre -cast cement panels the brick veneer is attached to. Phase 2 will then be to enhance the garage with a newly designed and installed fagade. These two phases will each need to be engineered and designed, have construction documents written, be put out to bid and awarded, and have construction oversight. Carl Walker, who has provided the City parking garage services in the past, will be an as needed sub - consultant on the project. Staff requests approval of this Resolution and Addendum, so Alliance Architecture can work with the Board of Public Works to resolve the fagade problems this garage faces. Alliance's professional services contract is in the not -to- exceed amount of $60,900 (fee plus expenses, and will be subject to approval of appropriations within the Parking Garage Fund. 227 W. SOUTH BEND, IN 46601 1 P: 574 - 235 -9371 1 FAX: 574- 235 -9021 1 SOUTHBENDIN.GOV RESOLUTION NO. 3208 RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING AND AUTHORIZING THE EXECUTION OF AN ADDENDUM TO THE MASTER AGENCY AGREEMENT (Wayne Street Parking Garage Facade) WHEREAS, effective January 1, 2014, the South Bend Department of Redevelopment, acting by and through its Redevelopment Commission (the "Commission ") and the South Bend Board of Public Works (the "BPW ") entered into a Master Agency Agreement which authorized the BPW to act as agent for and on behalf of the Commission for certain projects during 2014; and WHEREAS, pursuant to the Master Agency Agreement, the Commission desires to add the Wayne Street Parking Garage Facade Project to the Master Agency Agreement by way of this Addendum. NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission as follows: Section 1. The Commission hereby approves the Addendum to Master Agency Agreement Wayne Street Parking Garage Facade Project and hereby authorizes its execution in substantially the form attached hereto with such changes as the Commission may deem necessary or appropriate upon the advice of counsel, said execution thereof to be conclusive evidence of the Commission's approval of such changes. The Clerk is hereby directed to file a copy of the Addendum with the BPW. Section 2. This Resolution shall be in full force and effect after its adoption by the Commission. Section 3. Commission staff members are authorized to execute on behalf of the Commission any documents necessary to carry out the intent of this resolution. CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT South Bend Redevelopment Commission ATTEST: South Bend Redevelopment Commission ADDENDUM TO MASTER AGENCY AGREEMENT (Wayne Street Parking Garage Facade) This Addendum to Master Agency Agreement (this "Addendum "), made and entered into as of the 27`s day of February, 2014, by and between the South Bend Department of Redevelopment, acting by and through its Redevelopment Commission (the "Commission ") and the City of South Bend, Indiana, a municipal corporation duly organized and existing pursuant to the laws of the State of Indiana, acting by and through its Board of Public Works (the "BPW ") for purposes of the Commission designating the BPW to act as the Commission's agent to undertake the Wayne Street Parking Garage Facade Project (the "Project"). WHEREAS, effective January 1, 2014, the Commission and the BPW entered into a Master Agency Agreement which authorized the BPW to act as agent for and on behalf of the Commission for certain projects during 2014; and WHEREAS, pursuant to the Master Agency Agreement, the Commission desires to add the Wayne Street Parking Garage Facade Project to the Master Agency Agreement by way of this Addendum. NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, and for other good and valuable consideration, the receipt of which is hereby acknowledged, the BPW and the Commission agree as follows: 1. The Commission hereby empowers and appoints the BPW, pursuant to the Master Agency Agreement, to act as the Commission's agent for the limited purpose of contracting for and managing the completion of the Project, the scope of said Project being more specifically described in "Exhibit A ", attached hereto and made a part hereof. 2. All of the terms and conditions of the Master Agency Agreement shall control this appointment and this Addendum shall be attached to the Master Agency Agreement. 3. Commission members are authorized to execute on behalf of the Commission any documents necessary to carry out the intent of this Addendum. JOSEPH / WAYNE STREET PARKING STRUCTURE South Bend, Indiana Dear David: We thank you for this opportunity to submit to you our Proposal to provide architectural and engineering consultant services to the City of South Bend (Owner) for the Exterior Facade Renovation to the St. Joseph /Wayne Street Parking Structure. Alliance Architects (Architect) shall provide Services as listed herein. PROJECT UNDERSTANDING The Project Site is located at the northwest corner of St. Joseph Street and Wayne Street in downtown South Bend. The City, in addition to the desired exterior aesthetic improvements, requires a long -term solution to the on -going deterioration of the existing precast brick veneer system. Alternative methods of repair and /or replacement of the existing facade system have been submitted to the City by Carl Walker, Inc. (Facade Study dated January 23, 2013). The Architect will retain the consulting services of Carl Walker, Inc. The City will consider a phased project delivery approach to the renovation in order to eliminate the concerns of public safety (ie. Phase -1: Encapsulate or remove the deteriorating precast brick veneer facade system; Phase -2: Design and installation of new facade). The Project Budget is $650,000. ARCHITECT SCOPE OF SERVICES 1. PROJECT ADMINISTRATION a. The Architect shall manage the Architect's services and administer the Project. When Project requirements have been sufficiently identified, the Architect shall prepare and periodically update, a Project Schedule that shall identify milestone dates for design services furnished by the Architect, completion of design documentation provided by the Architect, construction procurement, commencement of construction, and Substantial Completion of the Work. c. The Architect shall engage the services of Carl Walker, Inc., and shall research Project Phasing, applicable design criteria, and shall consider the value of alternative materials and building systems, together with other considerations based on program, budget and aesthetics in developing the design for the Project. d. The Architect shall submit design documents to the Owner at intervals appropriate to the design process for purposes of evaluation and approval by the Owner. The Architect, upon request of the Owner, shall make a presentation(s) to explain the design of the Project. e. The Architect shall assist the Owner in connection with filing documents required for the approval of government authorities having jurisdiction over the Project, and for competitively bidding the Project. 2. DESIGN DEVELOPMENT PHASE a. The Architect shall discuss with the Owner the Owner's program, schedule, budget for the Cost of the Work, and alternative approaches to design /engineering and construction of the Project, including the feasibility of incorporating environmentally responsible design approaches. The Architect shall reach an understanding with the Owner regarding the Project requirements, including all necessary Phasing to address public safety concerns of the deteriorating precast brick veneer facade system. b. Based on the Project requirements, the Architect shall prepare Design Documents consisting of drawings and other documents appropriate for the Project and a preliminary estimate of the Cost of the Work for the Owner's approval. c. The Architect shall submit the Design Documents and preliminary estimate of the Cost of the Work to the Owner, and request the Owners approval. 3. CONSTRUCTION DOCUMENT PHASE a. Based on the Owner's approval of the Design Documents and preliminary estimate, the Architect shall prepare for the Owner's approval, Construction Documents consisting of Drawings and Specifications setting forth in detail the requirements for the construction of the Work. b. The Architect shall update the estimate for the Cost of the Work. Proposal Page 3 c. The Architect shall submit the Construction Documents and estimate to the Owner, advise the Owner of any adjustments to the estimate, and request the Owner's approval. The Documents shall be submitted for Owner review at 90% completion. d. The Architect, following the Owner's approval of the Construction Documents and the latest preliminary estimate of Construction Cost, shall assist the Owner with bidding, awarding, and preparing contracts for construction. !W,I0TRI Ii2 let :J:l_F9 a. The Architect shall assist the Owner with the advertising, bidding, bid evaluation, awarding, and preparing contracts for construction (Owner - Contractor Agreement). b. The Architect understands that the possible Phasing of the Project may require separate Bidding Documents in order to expedite a safe solution to encapsulate or remove the deteriorating precast brick veneer facade system. 5. CONSTRUCTION PHASE a. The Architect shall review and certify the amounts due the Contractor. b. The Architect shall review and approve or take other appropriate action upon the Contractors submittals such as RFI's, Shop Drawings, Product Data and Samples. c. The Architect shall visit the site at intervals appropriate to the stage of construction, to determine, in general, if the Work observed is being performed in a manner indicating that the Work, when fully completed, will be in accordance with the Contract Documents. d. The Architect shall attend all construction progress meetings. e. The Architect shall verify that all Project Closeout requirements have been completed, including punch -list inspection, final inspection, written warranties and final Certificate for Payment. BASIS OF COMPENSATION FEE = Not -to- Exceed Sum of sixty thousand dollars ($60,000). Progress payments for each Phase of service shall total the following percentages of the total compensation payable: Design Development Phase: 30% Construction Documents Phase: 45% Bidding Phase: 05% Construction Phase: 20% Total Compensation 100% Proposal Page 4 Additional Services not specifically identified in the SCOPE OF SERVICES, shall only be performed with authorization from the Owner. The fee for these services shall be computed on an hourly rate as follows: Principal $150 /Hour Project Architect $105 /Hour Engineering Consultant $105 /Hour CADD Technician $ 75 /Hour Administrative Support $ 55 /Hour REIMBURSABLE 1. Shall be in addition to the Fee paid to the Architect. 2. Shall include expenses incurred by the Architect and our consultants in the interest of the Project including printed copies, plotted reproductions and postage, and shall be invoiced at the rate of 1.10 multiplied times the direct expense incurred. EXPENSES = Not -to- Exceed Sum of nine hundred dollars ($900). We trust that these general terms meet your approval. If this Proposal is acceptable to you, please sign and date the two copies and return one copy to our office. Once we have your approval, we will complete an American Institute of Architects (AIA) Form of Agreement Between Owner and Architect (AIA Doc. B104- 2007).
