AN ORDINANCE AMENDING CHAPTER 40 OF
ORDINANCE NO. 4608 -63 COMMONLY KNOWN
AS THE MUQICIP -f�&Q CODE.

BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
SECTION I. That Chapter 40 of Ordinance No. 4605 -63
adopted by the Common Council of the City of South Bend, Indiana,
on the 14th day of October, 1963, and commonly known as the
Municipte Code, be and the same is hereby amended as follows,
to -wit:
That the zoning of the following described real estate
situate in the City of South Bend, Indiana, and described as
follows, to -wit:
A Lot or parcel of land in the Southwest Quarter (4) of
the Southwest Quarter (4) of Section 33, Township 38 North,
Range 2 East described as beginning on the South line of
Section 33 at a point 1105 feet East of the Southwest
corner of said Section 33; thence North on a line parallel
with the West line of said Section 33 a distance of 425.31
feet; thence East 198.45 feet; thence South on a line para-
llel with the West line of said Section 33, a distance of
425.31 feet, more or less to the South line of said
Section; thence West 193.45 feet to the place of beginning,
in St. Joseph County, Indiana,
and more particularly located for these purposes as 22785
Edison Road ( be changed from unzoned real
estate to B Residential and A Height and Area district.
SECTION II. This Ordinance shall be in full force and
effect from and after its passage and legal publication.

The attached rezoning petition of David W. Hadaway,
et al, was legally advertised under date of May 28 and
June 4 and given public hearing on June 7, 1966. The
following action was taken on June 21, 1966:
After due consideration it was moved,
seconded and unanimously carried that
the ordinance and site development plan
be recommended favorably to the Common
Council.
The deliberations of the Area Plan Commission and points
considered in arriving at the above decision are shown
in the excerpts of the minutes attached hereto and made
a part of this report.

EXCERPTS FROM THE MINUTES OF THE JUNE 21, 1966 MEETING OF
THE AREA PLAN COMMISSION.
OLD BUSINESS:
2. A proposed ordinance and site development plan of David
Hadaway, et al, to rezone from Unzoned to "B" Residential
Use and "A" height and Area District a tract of land lying
on Edison Road (Elwood Avenue) at a point where Woodland
Avenue (myrtle Road) would intersect the North line of
Edison Road if it were extended.
Mr..Kleva now stated that the petitioners had submitted a
new site plan, as requested, indicating in addition to the
building arrangement, landscaping, play areas, fencing and
parking areas.
After due consideration it was moved by Mr. Taylor, seconded
by Mr. Fitterling and unanimously carried that the ordinance
and site development plan be recommended favorably to the
Common Council subject to the following conditions:
1. Sidewalks and curbs shall be installed along Elwood
Avenue.
2. The middle two buildings shall be moved forward in order
to provide some appearance of variation in the building
arrangement.
The following points were considered in arriving at the
above decision:
1. This use will provide a buffer zone between the
commercial development along Lincolnway West and
the present and future residential development to
the west and south.
2. The density and arrangement of uses, as shown on the
site development plan, including screening should
produce a development which is not detrimental to the
present and future surrounding single family development.
