Ordinance No. 3702, being the zoning ordinance of the City of South Bend, be, and the same hereby is amended so that the zoning classification of the following described real estate in the City of South Bend,St. Joseph County, Indiana, towit: (see legal description attached) be, and the same is hereby changed from "C -1" Commercial District to "C" Commercial District. Section II. SLOUGH City of South Bend SlTY 0-RP4 WUTH BEND, lNr, South Bend, Indiana Gentlemen: The attached rezoning petition of Clarence Dockery was legally advertised under date of May 28 and June 4 and given public hearing on June 7, 1966. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the ordinance and site development plan be recommended favorably to the Common Council. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report. A proposed ordinance and site development plan of Clarence W. Dockery to rezone from "C =1" Commercial Use and "A" Height and Area District to "C" Commercial Use and "A" Height and Area District a tract of land lying approximately 296 feet North of McKinley Avenue on the WEst side of Hickory Road. There appeared John Montgomery, attorney, representing the petitioners. He described the present zoning in the surrounding area and stated that the petitioners desire to operate a Pizza Restaurant on this property, that the restaurant will seat 90 people and that the off — street parking would be provided in conjunction with the Dockery Shopping Center which is being developed on property surrounding the tract to be rezoned. Mr. Montgomery explained that this narrow tract had been left C -1 Commercial when the surrounding property was zoned commercial in order to protect a residence which has since been removed. Mr. Montgomery also informed the Commission that the site development plan contemplates any widening that might be done to Hickory Road. No one appeared in remonstrance. After due consideration it was moved by Mr. Fitterling, seconded by Dean Royster that since the proposed use is compatible with the future land use plan previously approved and based on studies carried out recently for the area, the ordinance and site development plan be recommended favorably to the Common Council. Motion unanimously carried. The Commission further directed the Secretary to indicate to the City Engineer that the Commission feels the number of proposed entrances and exits to the Dockery Shopping Center should be kept to a minimum with preferably not more than a total of 2 such openings.
