ORDINANCE NO. 4860 -66
AN ORDINANCE AUTHORIZING THE SALE AND
CONVEYANCE OF REAL ESTATE NOW MMED
BY THE CITY OF SOUTH BEND, INDIANA.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
SECTION I. That the following described real estate situate in
the County of St. Joseph, City of South Bend, Indiana and owned
by said City, to -wit:
Lots 329 and 330 as shown on the original plat of
South Bend being 130' wide fronting on St. Joseph
Street by 165' deep on East Wayne Street and
containing k acre of ground more or less all as
more specifically described in Warranty Deed record
123, page 10C in the office of the Recorder of
St. Joseph County, Indiana and alsoLot No. 67
of the original Plat of the Town of Lowell now a
part of the City of South Bend, Indiana and as
more particularly described in [warranty Deed
Record 36, Page 34C in the office of the Recorder
of St. Joseph County, Indiana,
shall be sold pursuant to the authority of the Acts of the
Indiana General Assembly for 1905, Chapter 129, Section 53,
page 219, the 50th Clause and pursuant to such authority the
City is authorized to petition the Judge of the Circuit Court
of St. Joseph County to appoint three disinterested freeholders
of the City of South Bend, Indiana to appraise said real estate
and said real estate shall not be sold for less than such
appraised value.
SECTION II. The Mayor of the City of South Bend is hereby
authorized in the name of the City of South Bend to execute any
and all necessary instruments to accomplish the conveyance of
said real estate and the City Clerk is authorized to attest any
such instruments and affix the seal of the City thereto.
SECTION III. This Ordinance shall be in full force and effect
upon its passage by the Common Council by a vote of not less
than two- thirds of the members of said Council and its
signature by the Mayor.
