ORDINANCE NO. 4859 -66
AN ORDINANCE AUTHORIZING THE PURCHASE OF
LAND BY THE CITY OF SOUTH BEND, INDIANA,
WHEREIN THE PURCHASE PRICE EXCEEDS THE
SUM OF $2,000.00.
BE IT ORDAINED BY THE CO2011ON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
WHEREAS, the City of South Bend, Indiana has a long range
established plan for the construction, widening and extension of
streets and highways within the City Limits and,
WHEREAS, from time to time it will become necessary to obtain rights
of way in order to accomplish the over all purposes, plans, and
responsibilities of the City of South Bend, Indiana, and,
WHEREAS, as a part of the plan referred to it is contemplated that
the City will in the foreseeable future, extend the length of
Chapin Street in the City of South Bend, Northwardly and across
what is now privately owned property and,
WHEREAS, a certain parcel of said real estate, now privately owned,
which lies in the right of way path, may be purchased for the sum
of $12,000.00 and,
WHEREAS, said purchase price is fair and reasonable and it is to
the best advantage of the City to purchase said right of way site
at this time.
NOW THEREFORE, BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA:
SECTION I. That the purchase by the City of south Bend, Indiana
for the sum of $12,000.00, of the following described real estate
situate in the County of St. Joseph, City of South Bend, Indiana,
to -wit:
A part of Bank Out Lot No. 34 of the first Plat of
Out Lots of the Town, now City of South Bend,
bounded and described as follows, to -wit:
Beginning at the Northeast corner of said Lot;
thence running West on the North line thereof
100 feet; thence South 150 feet; thence East
100 feet to the East line of said lot; thence
North along the East line thereof 150 feet to
the place of beginning.
is authorized by the Common Council of the City of South Bend,
Indiana, pursuant to the authority contained in the Acts of the
Indiana General Assembly for 1905, Chapter 129, Section 93, Page
219 as amended by the Acts of the Indiana General Assembly of
1909 and 1913.
SECTION II. This Ordinance shall be in full force and effect
after its adoption by the Common Council of the Civil City of
South Bend, Indiana, and approval by the Mayor.
