A salary ordinance fixing annual pay and fringe benefits for members of the South Bend Police Department was enacted in 1997 for a period of four years ending December 31, 2001, i.e. Ordinance No. 8808-97. As of the filing date of this Substitute Ordinance, the following provisions incorporate the recommended annual pay and monetary fringe benefits for sworn members of the South Bend Police Department for calendar years 2002, 2003, 2004 and 2005. Accordingly, this Ordinance is in the best interest of the City, the South Bend Police Department, and citizens of South Bend, Indiana. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: Section I. Designation of Officers: During the 2001 Police negotiations, the City of South Bend recognized the F.O.P. Bargaining Committee of the Fraternal Order of Police, Lodge No. 36, as its sole bargaining unit for the negotiation of annual pay and monetary fringe benefits for sworn members of the South Bend Police Department, excluding the Police Chief, Division Chiefs, and Captains. In light of the fact that ratification by the Lodge has not been achieved as of this filing, this recognition is solely for annual pay and monetary fringe benefits for calendar year 2002 for such sworn members. Pursuant toI.C. 36-8-1-12, the Police Chief, Division Chiefs and Captains ofthe South Bend Police Department are designated in this Ordinance as "Officers". Page 1 of 6 ' , Section II. Additional Areas of Compensation: A. Maximum Amounts: All monetary areas addressed in this Ordinance shall be the maximum amounts permitted in each calendar year. B. Court Time Pav: If an officer or sworn member of the South Bend Police Department is subpoenaed to court or is ordered to appear at any given location to validate a complaint or warrant, and if that officer or sworn member isoff--duty, that officer or sworn member shall be paid overtime. Such court time pay shall be paid at the overtime rate of pay. Such officers and sworn members shall receive a minimum of four (4) hours of pay for appearing on their scheduled day off; and a minimum of two (2) hours of pay for appearing when off duty on a regular scheduled work day. C. Overtime Pav: If a sworn member is required to remain on duty in excess of the regularly scheduled workday, he or she shall be entitled to overtime pay. Such sworn member shall be paid at the rate of one and one-half (1 %) times his or her regular rate of pay. Overtime shall be calculated by quarter-hour increments. D. Critical Duty Day Stipend: A critical duty day pay stipend is established in the amount of One Hundred Fifty and 00/100 Dollars ($150.00). There shall be six (6) critical duty days established by the Board of Public Safety by resolution for calendar year 2002. Commencing 2003, officers assigned to D.A.R.E., S.T.O.P., S.C.U., or South Bend Community School Corporation, shall, while so assigned, shall not be eligible for Critical Duty Day Stipend, while working as part of their regular duty assignments. E. Detective Classification Pav: Sworn members within a pay classification of Sergeant, who are assigned to the Investigative Division of the Police Department on a continuing basis, who are qualified and have previously passed the prior testing procedures, shall receive additional annual pay in the total amount of Six Hundred Sixty Three and 00/100 Dollars ($663.00) in calendar years 2002, 2003, 2004 and 2005. Said pays shall be paid on a divisible amount which is paid on a bi- weeklybasis. Said amounts shall be prorated in any year a qualifying Sergeant retires, resigns, or otherwise leaves employment. I. Annual Cash Allowance: Officers and sworn members shall receive the following annual cash allowance. One-fourth (1/4) of the annual sums listed shall be paid each calendar quarter. 2002 2003 2004 2005 $2,200 $1,800 $1,400 $1,000 Said annual cash allowance shall be prorated in the first year of employment from the sworn member's hiring date until the end of the calendar year. Said allowance shall be prorated if a sworn member or officer retires, resigns, otherwise leaves employment before the end of the calendar year. J. Loamy Pav: Qualifying officers and sworn members holding the rank of corporal and Page 3 of 6 above, shall receive additional compensation in recognition of cumulative service on the South Bend Police Department. Such Longevity Pay shall be paid in 2002, 2003, 2004, 2005 and shall not be attributed to the annual salary base for pension purposes. Said pay shall be paid with regular payroll amounts throughout the designated four year period and shall be as follows: Cumulative Years of Service Commencement Date Amount 10-14 years Beginning in the 11"' year $415 15-19 years Beginning in the 16`'' year $575 20+ years Beginning in the 21S` year $1,050 K. Tuition Reimbursement: Qualifying officers and sworn members of the South Bend Police Department participating in the tuition reimbursement program shall be entitled to the following maximum dollar amounts for course tuition Course Grade Maximum Amount Reimbursed by City A 100% of tuition costs only up to a maximum of $1,500 B 50% of tuition costs only up to a maximum of $1,000 Tuition reimbursement shall be on a "first come, first serve" basis. All governing regulations must be complied with by qualifying officers and sworn members in order to be paid any tuition reimbursement. L. Operation Safe Neighborhood Reimbursement: Qualifying officers and sworn members of the South Bend Police Department who establish legal residence within designated areas of the City of South Bend limits and reside on a continuous permanent basis within such designated areas with the City for the period of time he or she is seeking reimbursement shall be entitled to One Thousand Five Hundred and 00/100 Dollars ($1,500.00) of his or her annual mortgage or rental amount. Qualifying officers and sworn members shall be entitled to be reimbursed by the City on a quarterly basis. All governing regulations must be complied with in order to qualify for said reimbursement. M. Life Insurance: The City of South Bend shall continue to provide life insurance coverage on all officers and sworn members of Twenty Thousand and 00/100 Dollars ($20,000.00). N. Health Insurance: For calendar year 2002 only, the City shall maintain anon-Preferred Provider Organization (PPO) medical insurance program which includes a Seven Hundred Fifty and 00/100 Dollars ($750.00) annual deductible and which shall be subject to a 70/30 co-insurance payment up to a limit of One Thousand Five Hundred and 00/100 Dollars ($1,500.00) per year. For calendar year 2002 only, the PPO includes a Two Hundred Fifty and 00/100 Dollars ($250.00) annual deductible and which shall be subject to a 90/10 co-insurance payment per year up to a limit of One Thousand Two Hundred Fifty and 00/100 Dollars ($1,250.00) per year. The contribution by officers and sworn members of the South Bend Police Department who desire single health insurance coverage for the self-funded insurance program of the City of South Bend shall be Twenty and 00/100 Dollars ($20.00) per month and for retirees shall be Seventy Eight and 40/10 Dollars ($78.40) per month in plan year 2002 only. The contribution by officers and sworn members of the South Bend Police Department who desire dependent health insurance coverage for the self-funded Page 4 of 6 insurance program of the City of South Bend shall be Fifty and 00/100 Dollars ($50.00) per month and for retirees shall be Two Hundred Twenty Seven and 18/ 100 Dollars ($227.18) in plan year 2002 only. Commencing calendar year 2003, the monthly contribution for health insurance coverage for active officers for calendar years 2003 through 2005 shall be as follows: 2003 2004 2005 Single $36.00 $38.00 $65.00 Family $95.00 $98.00 $125.00 The monthly contribution for health insurance coverage for retirees for calendar years 2003 through 2005 shall be as follows: 2003 2004 2005 Single $58.00* $67.00* $95.00* Family $279.00* $300.00* $335.00* * Retired officers who are not members of the FOP shall pay an additional $50.00 per month. The City shall continue to contribute Five Hundred and 0/100 Dollars ($500.00) to each qualifying officer's and sworn member's individual flexible spending account, each plan year during years 2002 through 2005. O. Personal Days: Each officer and sworn member with more than one (1) full year of service shall receive on January 1 S` of each year, seven (7) days of personal time for use in that year. No sworn member shall receive personal time during his or her first full year of service. Upon the anniversary date of swearing in, each sworn member shall receive personal time to use in the remainder of that calendar year in an amount equal to one (1) day for every fifty (50) calendar days remaining in the year plus one (1) additional day for any fraction remaining, not to exceed a maximum of seven (7) days. Personal days are designed to be used on a "use it or lose it basis" subject to further conditions which maybe established by the Board of Public Safety. Each sworn member shall have the opportunity to earn three (3) additional days of personal time through shooting subject to conditions as may be established by the Board of Public Safety. P. Retirement Sick Leave Buy-Back: For calendar year 2002, the Retirement Sick Leave Buy-Back program shall continue with the number of sick days which have been accumulated in an officer's or sworn member's sick bank being sixty (60) days with the rate of reimbursement being one-half (%2) the hourly rate of the base pay for the rank of Corporal. Q. Sick Leave Cost Reduction Pro ream: For calendar year 2002, the Sick Leave Cost Reduction Program shall continue in effect whereby a police officer may be compensated for relinquishment of earned sick time through and including December 1, 2005, with the Board of Public Safety establishing specific criteria and conditions. R. Field Training Officer (FTO): An qualified Field Training Officer (FTO) shall be entitled Page 5 of 6 to Twenty and 0/100 Dollars ($20.00) per day for each day which the officer is qualified, assigned and performs field training activities with new recruits. S. On-Call Duty Pay: Effective January 1, 2002, there are established ten (10) On-Call Duty Pay categories. Six Hundred Fifty and 00/100 Dollars ($650.00) per category per year shall be divided among the assigned police officers in each of the following categories. Such division ofpay shall be determined according to frequency of assigned on-call days in the respective category and shall be paid on a quarterly basis. The "On-Ca115tatus Categories" are: Major Crimes Investigator Major Crimes Technician Sex Offense Investigator Arson Investigator S.T.O.P. Unit Special Crimes Unit Investigator Special Crimes Unit Technician Investigative Division On-Call Duty Officer Traffic On-Call Duty Officer Traffic On-Call Diagramer Section IV. Body Armor Vest Ouartermaster System: All uniform division police officers shall continue to be provided with aCity-purchased body armor vest to be replaced pursuant to the existing quartermaster system. Twelve (12) new body armor vests shall be purchased by the City each year and made available to non-Uniform Division police on an on-need basis, first come first serve. Section V. Service Year Defined: A. The first service year for a member of the South Bend Police Department commences upon the individual being sworn in before the Board of Public Safety as a member of the department. The second service year shall begin on the next succeeding January 15t, and service years shall continue to increase until the member attains the maximum salary for the particular rank he or she may hold. B. Advancement from the rank of Patrolman First Class to Corporal is dependent upon three (3) complete calendar years of service plus a determination of satisfactory performance of duty and promotion by the Board of Public Safety. Section VI. This ordinance shall be in full, force and effect from and after its passage by the Common Council and approval by the Mayor.
