AN ORDINANCE DETERMINING THAT IT IS IN THE
L. BLOUGH PUBLIC INTEREST TO ACQUIRE THE MASS TRANS -
NTH BEND, INM PORTATION SYSTEM OF NORTHERN INDIANA
TRANSIT, INC., WHICH SHALL BE A DISTINCT
MUNICIPAL CORPORATION AND WHICH SHALL BE
KNOWN AS 11THE SOUTH BEND PUBLIC TRANSPORTATION
CORPORATION" AND DEFINING THE CORPORATE
LIMITS OF SAID CORPORATION.
WHEREAS, heretofore on the 23rd day of January, 1967, Northern
Indiana Transit, Inc., an Indiana corporation, and operators
of the mass transportation system in the City of South Bend,
Indiana, filed their request with the Common Council of this
City asking that the Council determine among other things
whether it is in the public interest for the public to acquire
the system and,
WHEREAS, Northern Indiana Transit, Inc., is of the opinion,
by virtue of said request, that public acquisition of the system
is necessary to enable the system to render adequate service
within the City and,
WHEREAS, thereafter the Common Council caused to be made studies
to determine whether it is in the public interest to the
public to acquire the system and,
WHEREAS, as a result of such studies it is the solemn judgment
of the Common Council that public acquisition of the system is
necessary to enable the system to render adequate service within
the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA:
SECTION I. The establishment and maintenance of an urban mass
transportation system is necessary to the welfare of the general
public in that it expands the economy and social opportunities
available to the residents of the City and benefits those who,
for economic reasons, reasons of health, reasons of age and
demonstrated unfitness to operate a motor vehicle cannot
freely move about except through the services rendered by an
urban mass transportation system.
SECTION II. That there is hereby created a municipal corporation
which shall be known as "South Bend Public Transportation
Corporation" for the purpose of acquiring the mass transportation
system of Northern Indiana Transit, Inc., pursuant to the
authority contained in the acts of the Indiana General Assembly
for 1965, chapter 337.
SECTION III. That said corporation shall have a Board of
Directors consisting of five in number.
SECTION IV. That the corporate boundaries of the South Bend
Public Transportation Corporation shall coincide with and be
identical to the corporate boundaries of the Civil City of
South Bend, Indiana, as they presently exist or as they.chan&
from time to time for any reason.
SECTION V. This Ordinance shall be in full force and
effect from and after its adoption by the Common Council of the
Civil City of South Bend, Indiana, and approval by the Mayor.
